Dear all,

I'm living in Pakistan with my US national wife. We met in London last year and married in May 2013. We want to settle in USA but don't know where to start from.

We applied our K1 fiance' visa in July 2012 which was approved but we couldn't go ahead with that since my wife was a student at that time and didn't have enough funds / income to support me. She has moved to Pakistan with me and don't want to live separately until we get the US visa.

My questions are:

1. Can we apply directly from Pakistan i.e DCF or she must go back to US to file the petition ?

2. She still hasn't got enough funds/income to support me, Can I show my bank balance and Assets (worth 100 K) to prove that I can support myself and her or can someone sponsor us who isn't our relative ?

3. Since she has moved to Pakistan with me will they question her about her domicile etc ?

4. Do we need to withdraw our K1 application which expired in May 2013?

Any help will be appreciated, thanks.

1. Can we apply directly from Pakistan i.e DCF or she must go back to US to file the petition ?

Ans: DCF fromPpak is not available and if she wants to apply from Pak then go ahead. She need all documents which available here ( on website)

2. She still hasn't got enough funds/income to support me, Can I show my bank balance and Assets (worth 100 K) to prove that I can support myself and her or can someone sponsor us who isn't our relative ?

Ans: You can not support your self for USA because you are beneficiary so arrange a co-sponsor in USA

3. Since she has moved to Pakistan with me will they question her about her domicile etc ?

Ans: She need her domicile with application and certificate ( as a USA citizen )

4. Do we need to withdraw our K1 application which expired in May 2013?

Ans: Since you are married now then you can not restart K1 application. You have to submit K3 or CR1/IR1 application

If you need more explanation , we all here

1. above answers are correct

2. you can use the 100K as support for yourself, but best to put in joint account with her name also, yes you can use your own assets to support you, but it is difficult.

3. yes, usually she will just have to tell them that she will reestablish her domicile and or have an address you two will live at.

4. is the expiration the 4 months after USCIS approval? if so then it is probably still at the embassy sometimes up to an year. Best for her to write letter and cancel. just tell them you got married and will apply I-130, only she can cancel I would write letter, to both USCIS and embassy.(same letter) just so this will not be an issue later.

Thanks for your time to answer :) So what is the best option for us to apply since she can't go back to US to file the petition.

DCF = Direct Consular Filling that mean you can submit your application at consular office which is not possible in PAk ..

Second thing I said your wife can apply from Pak that means she send documents to the : ( If she belongs to below cities )

Alaska, American Samoa, Arizona, California, Colorado, Florida, Guam, Hawaii, Idaho, Kansas, Montana, Nebraska, Nevada, New Mexico, North Dakota, Northern Mariana Islands, Oklahoma, Oregon, Puerto Rico, South Dakota, Texas, Utah, Virgin Islands, Washington, Wyoming

USCIS Phoenix Lockbox

For U.S. Postal Service (USPS) deliveries:

USCIS
ATTN: I-130
PO Box 21700
Phoenix, AZ 85036

For Express mail and courier deliveries:

USCIS
Attn: I-130
1820 E. Skyharbor Circle S
Suite 100
Phoenix, AZ 85034

In short she does not need to go to USA for submitting documents...She can do it from here

Beneficiary=you= use your address

Petitioner=your wife= use US address

Thanks again for your time :) I got it but unfortunately she doesn't live in any of these states so what the next best option available for us.

She is from Pittsburgh, PA.
