Hi Friends, I got RFE for my father's IR5 case for late registered Birth certificate. they are asking for evidence that establishes parent-child relationship. has anyone gone through the similar experience? if so, what are the documents that were submitted to satisfy the ask? They are looking for the following document. since Pakistan doesn't have established system to track any of the listed asks, it will be not easy to get any of the documents from 1986 (my birth year). 1.Religious documents 2.Early school records 3.Medical records 4.Census Records 5.Affidavits: Written statements sworn to or affirmed by two persons, other than yourself and the person for whom you are petitioning. LATE REGISTERED BIRTH CERTIFICATE The birth certificate submitted on behalf of you was registered on July 12, 2012, 26 years after the actual event occurred. In Matter of Rehman, 27 I&N Dec. 124 (BIA 2017), the Board of Immigration Appeals (the Board) addressed delay-registered births. The Board held that a late registered birth certificate might be sufficiently reliable proof of a parental relationship. The Board provided a non-exhaustive list of factors to consider when making a determination.Even if a birth certificate does not reflect that its registration was contemporaneous with the birth, an adjudicator may conclude that it is sufficiently reliable to establish parentage,depending on the circumstances. In making this determination, the adjudicator should consider all relevant factors, including, but not limited to, (1) information in the FAM regarding the availability and reliability of birth registrations in the country of birth during the time period at issue; (2) the length of time between the birth and the registration; (3) any credible explanation proffered by the petitioner as to the personal, societal, or historical circumstances that prevented a particular birth certificate from being registered contemporaneously, and any evidence in support of that explanation; (4) any credible explanation for why a particular birth certificate was lost or destroyed; (5) any evidence that the parental relationship was independently corroborated prior to the registration of the birth;(6) the length of time between the birth registration and the filing of the visa petition; and (7)information regarding whether the document was based on facts that were contemporaneous with the birth or on facts that were more recently established. Matter of Rehman, 27 I & NDec. 124 (BIA 2017). The documents submitted as evidence of a parent-child relationship were executed 26 years after the actual event occurred. When considered in light of the factors listed above and with all other evidence currently in the file, USCIS has determined that the birth certificate is insufficiently reliable and will be accorded little or no weight. Therefore, you must submit additional documentary evidence Any help will be highly appreciated.
  2. Anyone know if the embassy is doing any interviews at Islamabad. How long is it taking from submitting your paperwork to NVC and to get your interview? This is for a spouse visa.
  3. Hello, I am petitioning for my husband and my income is not sufficient. However, I have made my maternal cousin, my joint sponsor for AOS income purposes. I am thinking of providing a letter with documents that states that my joint sponsor-my cousin is going to support my husband. My husband and cousin have not met each other. Does anyone have a sample letter of this kind that states that my joint-sponsor will support us. (my joint sponsor and I live on separate address) can someone send me a sample letter which they can write? Thank you so much.

  5. Hello, I really need help. My Fiancé applied for K-1 Visa in Oct-Nov 2019 in America and Visa came to Pakistan Embassy in April 2020. There’s no update till this date. I know due to Covid Embassies are not working on K-1 Visas. Please tell me what can we do to expedite the process. Should we change it spouse visa. What are the options. Can someone help.
  6. Okay....I don't want to be morally judged here, just requesting some honest advice. My name is Jess and I am 37 years old and I am married to a Pakistani man named Amir who is 34. We got married in January of 2020. Previously, we filed a K1 but were denied. I believe it was due to the "red flags" associated with our case..which are all my fault. I have been married three times before this marriage and engaged once. (Please, please no rude remarks in regards to that.) I will explain more. Fresh out of high school, I married my highschool sweetheart at age 18. We were both in the US Army. He cheated on me and that marriage ended after only six months. At 20, I married a man from China while I was there teaching. That marriage ended in divorce also because he was married already. I did not know. I filed a CR1 visa for him that was approved by USCIS but I withdrew the petition. After this teaching gig, I lived abroad in Kazakhstan and was briefly engaged to a Russian man. I filed for his K1 but we broke up before the interview. I married a man from Lebanon when I was 25 and we lived together in Chicago for seven years and had one child, a daughter, together. We amicably separated. About three years ago, I met my husband who is from Pakistan. He was visiting a local museum with his family and I was working there. We became friends and eventually began a relationship. We first filed a K1 but were denied at the visa interview. We have since married in his country of Pakistan. Considering my past, what real chance do we have that our petition will ever be approved by such a strict embassy? I know my story is super messy. I made a lot of mistakes when I was young and I will be the first to admit that. Otherwise, we meet the financial requirements, ect.. I have been to Pakistan 6 times and we have vacationed together in the Maldives and Dubai.
  7. Long story short, we both agreed that we'd only meet when we both were financially capable. He landed a great job last year and so did I. He's flying to me and I already have both my phones emptied out to record every minute and take pictures like crazy. We've been together since 2017, we met through reddit and I have all the original messages since then, from facebook messenger, reddit, whatsapp, etc. the years were tough but 2019 was our turning year, and after a year of saving, we are both having the dream vacation we both deserve. This is our first IRL meeting. Is there any advice you all can offer? I already told him to keep the boarding pass, ticket, gate pass, etc, anything he has during his trip with him and not to discard it starting from JFK and back to JFK, to preserve them in a mini folder or something. We are going to be spend about 13 days together, he will be with me on September 30th, and leaves on the morning of October 11th. His flight actually leaves on 28th, but all airlines are taking 2 days, with 20 hour travel time, there isn't any airline that can fly faster, 19-20 hours is the lowest flying time we've found. He only gets 13 days off a year. He will get 13 days again in April 2021. As far as I know, there is no way for us to get married here, legally. so there's no chance of a CR-7 taking place. I want to know if this visit will be enough for him to file for a K1 when he flies back? If anyone who has filed a K1 with our situation in mind can help me here, it would be great.

Hello, so my husband had his second interview oath/fingerprints in July and was told to submit new medical along with a valid passport, which we did in august, today my husband received a call from the embassy asking to confirm that it was medical and passport that he mailed and if there’s an additional phone number for him, the guy on the phone stated he’s going to pass all my husband information to the officer for processing..on ceac our case went from refused to administrative processing and date updated. Any idea if this may FINALLLY be some good news after 17 months total of AP!!!!
  9. Hello members, For about eight months now, my husband's CR1 visa is stuck in "pending security checks" at the Potomac center. I have inquired multiple times but keep getting the same response. My congressman also wrote to them on my behalf and got the same response. We both have clean records. I can't imagine why we have remained pending for so long. Has anyone else been in this situation?

Soooo my husbands interview was 4/9/2019, they kept his passport and told him everything looked good and they will email him, 24 hours after interview we got ds5535 questionnaire which we did and sent back. We’ve been going back and fourth with inquires but nothing. Then randomly July 16 2020 we got an email to bring new medical and come for oath/fingerprints..we were so excited the only downfall was passport was expired so he wasn’t able to get a medical done but I told him to just go there the embassy was empty when he went they told him oh we can’t see you without medical but my husband told them NO this is ur fault my passport is with you guys and it expired in April you all don’t reply so they went on with everything else and gave him a paper which stated he can get medical and sent it to them we’ve submitted it all on 8/17/2020 we got an email from the embassy many weeks later stating they’ve received all documents and here and STILL nothing! -any idea if Islamabad embassy is issuing visas? -anyone know if there’s been any good outcomes lately? -been in AP for 17 months!!!!!!!!!!!

  12. Hi guys, Quick question. My fiancé interviewed at the US embassy in Islamabad pre corona in February of 2020. They kept his passport and gave him a slip with 221g asking us to complete a questionnaire. He completed that and no word since. We’ve been hearing of people being granted visas so we know the embassy is up and running. When we check our case status online on the CEAC website. Our status says “no status” Is that normal? Has anyone else also seen that? We also emailed with an inquiry months ago but no word from that either. If anyone can shed some key on this long process. We are lost and hanging on to hope. Thanks!
  13. Hey, We were dqed in april 2020; now interview is going to be in dec. Have heard recently from a source that we qualify to bring i864 aos to the interview; but my spouse uploaded i864ez at NVC stage and got successfully dqed ! now i am confused can CO reject i864EZ ? My spouse fulfil all three requirements mentioned on EZ form !! I need to understand why i864 is needed ? And not EZ !! what should we do?

Hello Everyone, Since I am nearing the end of my degree, I just learned from my university that I can invite guests to my commencement ceremony (to anyone out side of the country ) next year with an embassy letter from the university. I am thinking of doing that to invite my husband and/or my in-laws to attend the ceremony if his and their visa is approved for visiting and after some time they can go back. I am not sure entirely about this since we may have ONLINE COMMENCEMENT CEREMONY in 2021 due to COVID-19 … however, if I plan to do this, will this bring in any other issue/hurdle with the spouse visa case (CR1-IR1) for my husband that he has already visited USA or something like that...? any ideas/suggestions/tips/advice on this? thanks

Hello, we have our interview in dec, my question is my husband last visited at the end of 2018, later on he planned n booked tickets cause the process was taking so long to come meet me in 2020 afterwards lockdown n corona happened !! We have proofs of tickets etc n ongoing communication between us on regular basis. do you think it will be an issue on interview day n whether they will understand that why he didn’t visit after marriage ?

I applied for my parents and filed I-130 Petition in Oct 2019, For proof of their marriage I provided Nadra Marriage Certificate , 2 witness affidavit who attended the wedding and Civil Magistrate affidavit for Nikkah nama unavailability with my parents petitions. Also other additional documents as Family Tree was also provided. After 8 month my mother petition has been approved while for my father they said to get a letter from Nikah Registrar stating that they could not find the record of Nikkah nama. It has been 40 years since my parents are married and getting any document so old is not possible. Anyone who went through the same issue , who could guide me how to deal with it.
  18. Earlier november 2020 Applied for B1/B2 visa at Karachi consulate CO said your visa is approved later after 2 weeks they requested Additional information and refused the case under 221(g). It was an emergency appointment. Did anyone else got into same thing and was interviewed recently. Have your visa been approved recently?

  20. Hello, I have heard that applicants DQ'd in March 2020 are receiving interview dates. Are there any updates regarding the applicants DQ'd in April and May 2020? Any general updates regarding the US Embassy Islamabad that how they are proceeding with the cases. Do they schedule IR1 cases first and CR1 later, or it is based on the DQ'd date?
  21. Hello Today my wife had her CR-1 Interview in Islamabad, Pakistan. They gave her 221G ( See attached Image ) form asking to upload Petitioner and Beneficiary previous marriage photographs my wife told the CO /interpreter that we don't have photos of our previous marriage she told her that is your problem and walked away . I was able to find 2 pictures of me with my ex. But my wife she can't find any pictures of herself with her ex or other family members from her previous wedding day. What should we do ? Upload what we have? They kept her Passport original marriage certificates and previous marriage termination documents for both wedding photos and NADRA FRC Any assistance you can provide would be greatly appreciated

  23. Hello, Has Islamabad issued any visas in October ?? I’ve hear August and September some were issued. My spouse was emailed to come for an oath/fingerprints in July and was asked to submit new medical and updated passport, we submitted that In mid august and Since then we’ve heard nothing! The embassy replies to inquires which seems like automated replies and that’s the only time our date updates in ceac. Recently 2 days ago the date updated on its own! We don’t know what to think and are so over all this! Basically in AP for 17 months originally had interview in April 2019 and got ds5535 I day after that interview

  25. Hello everyone, This is my very first post here. I have heard excellent things about this website, so I thought I would give it a go. I will briefly address my immigration situation here now. My husband and I have been together for five years now. He is from Pakistan and I currently live in Ohio, US. We filed a K1 Fiance Visa Petition and were denied in April of 2019. At that point, I had been in Pakistan for a total of 1 1/2 years. The reason we were denied was vague. I was quite perplexed as we were physically in the same place for quite some time. The CO was quite rude and threatening to my husband. I did end up getting my local Congressman involved but, ultimately, we were still denied. I came to learn later that most K1 petitions are denied from that embassy. We legally married in Peshawar, Pakistan and I returned to America and filed the CR1 in September of 2019. So far, no NOA2. I have not been back to Pakistan since August of 2019 due to health reasons- an unexpected, severe surgery- and now Covid. I do plan on attending the eventual interview at the embassy, if we are approved by USCIS. From personal experience, how does a K1 denial effect the CR1? Especially at such a difficult embassy (Islamabad). I have heard varying things. Any input would be so greatly appreciated.
