I-864 QUESTION

Hi, my husband and I are filing an I-130 for me (the beneficiary)

We are looking into all the paperwork we MAY need in the upcoming months.

We are looking at the I-864 and may have his step-mom be the joint sponsor if needed.

Now, does my Husband fill out the I-864 OR does his Step-mom?

we are really confused and just want to make sure we are doing everything right.

Your husband has to file i-864 (I guess it won't change even if the petitioner is outside US), even though there is zero income. Did he file US tax returns while he was away from US.

Step-mom also file i-864 as a joint sponsor.

You husband should file his back taxes. All LPR and USC are required by US law to file taxes no matter where they live. Most likely unless he made over 90k per year (I'm unsure of the exact figure) he will not have to pay any taxes.

He has had no income for the past 2/3 years and has been using his savings. Does he still need to do this?

no he will have to write a letter stating he did not file his taxes because he was unemployed.

but he still has to sign a completed I-864.

He writes the letter (needs original signature) and adds it to his I-864 paperwork. My American husband was the same when he lived with me in Ireland, here is what he wrote:

To whom it may concern,

I am Penguin_ie's husband and petitioning sponsor. During my three years in Ireland I did not work; I used savings and was maintained by my wife on her salary. Thus, I had no income or significant holdings in the USA was not required to file US tax returns with the InternalRevenue Services.
