One is supposed to file returns even while working outside. However if you make below a limit ( ~$8000) for single you don't owe any tax and hence no need to file. Therefore, in his case I think, the second might apply. While filing i-864, he will need to explain why he didn't file the returns.

Hopefully it doesn't become a problem - He hasn't worked while living here.. Only I have.

Will this be all he has to say? He has bank accounts in the US with his savings.

Will be a problem that he's been living here and not in the US? We plan to live at his mothers house 2-3 weeks until we secure an apt/house.

He will have to prove domicile in US. Search for domicile in VJ and you will come across many threads discussing how to prove domicile.

As you are aware my husband has been living abroad for 1.5 years - He still has his car back home at his mothers house, registered in his name, and when we were on vacation there last month he took some money out of his bank account. Also, we have been looking at apartments online.

Would this be enough? If we printed out some quotes from agencies maybe?

I have a question.. I was just told by someone who went through the K1 visa process that if my husband has paid enough SS credits, we won't need to file I-864. can anyone confirm this? Isn't the I-864 Just part of the process??

It's not for your husband, it for you.

If you (the intending immigrant) had worked enough to earn (not paid) Social security credits, then you don't need I-864 filled out on behalf of you. Please look at page 2 of i-864 instructions.

I believe that situation typically applies for someone who is already in the US and is undergoing adjustment of status.

This is my first time posting. My priority day is 05/14/2013. It's going on 6 months Nov 14 since Chicago lockbox received my I130. I need answers ASAP. I am 25 weeks pregnant and I am a USC and live in NY. My husband lives in Dominican Republic. if my I130 gets approve, I won't be able to travel after my 29 weeks.. I'm due Feb 24th 2014 and this is freaking me out. My question to u guys is, if they call us for the interview during that time, can I attend an interview here in NY while my husband attends his in DR. I really don't want to postpone the interview. PLEASE HELP!!!

Why do you need interview? You are the petitioner, correct?

That was one concern of ours, having pictures that showed a time span. I cover my hair and I wear the same type so in every picture I look the exact same! As it was in Jamaica there aren't really distinguishable seasons either but I divided my pics up by trip, took a copy of each passport stamp and also attached each itinerary. Then we showed pages of call and text logs for several months as well. Thankfully they accepted it all but I was a bit worried. Best wishes for you and your husband!

good luck and please remember all cases are different so while some people get approved quickly others are waiting way beyond the normal processing times like me. I'm 15 months into this whole process.....and no rfe's, no criminal activity and we have a daughter

Good Luck on your journey! Maybe I missed it on your list, but you did not mention passport pictures for both the petitioner and beneficiary. Monday is a holiday by the way so you might be sending it on Tuesday. I am also sending mine the same day BTW.
