Please help!

I am new here. Thank you for everything you guys do.

My Haitian fiance lives in Canada on a work permit. The Canadian immigration has his old passport.

Now he needs a passport for his interview coming up...the Haitian consulate won't let him apply for a new one because he's not legal there.

We are panicking and I don't know what to do.

Any ideas?

If he is in Canada on a work permit then he is there legally. Why does Canadian immigration have his passport, was he trying to renew or get a different visa in Canada? He should be able to contact them and ask for his passport back.

They told him he would have to leave the country right away if they give his passport back to him. Weird!

Looks like he is not legal there. Well, it's probably pending permit or renewal otherwise they won't hold your passport and not give you back

K1 (I-129F) petition filed in August 2013 (Approved Feb 20th 2014)
13th May 2014: AOS (I-485) & EAD/AP combo card
21st May 2014: NOA 1 and biometric letter
11th June 2014: biometric appointment
13th June 2014: RFE received via mail
16th June 2014: replied to RFE
6th August 2014: EAD Approved, AP still in initial review
12th August 2014: got tracking number for EAD
( ) August 2014: Received EAD (I forgot what date I got them but I did receive them less than 5 days from the 12th)
10th September 2014: Interview Waiver received (I wished I was interviewed)
April 23, 2015, we registered your permanent resident status and mailed you a Welcome Notice

If that's the case he also wont be able to interview in Canada.

He can be interviewed in Canada when he has his passport back with LEGAL permit on the passport.

He can only interviewed in his country of origin if otherwise.
