Please help us. My wife's mother is in the hospital and my wife may need to return home. We have just gotten married Saturday and have not even begun to fill for AOS or AP. I have heard there is an Emergency Ap, but I don't know where to turn. Who should I contact? What is the contact information? Thanks.

You will need to make an INFOPASS appointment. Be prepared to document the reasons for the request.

You will need to file for AOS to be eligible for AP.... there is no emergency AP for a K1 as you are now married the only choice you have is to file for AOS and then file for emergency AP...

There is another choice: abandon your status and start over with a petition for spouse after the emergency.

One would argue that that is not a very popular choice, hence why it was not mentioned ;)

However, if needs really, really must, yes she can abandon status and you can reapply for spousal visa after the emergency is over.

Make sure you're wearing clean knickers. You never know when you'll be run over by a bus.
