Hi guys!

We're hoping you can help us with this. I'm from Argentina and my fiance is from the US, right now we both live in Argentina (he has been living here for 7 years) and we both want to move back to the US after our K1 Visa is approved.

We are waiting to find out the date but just now I’m coming to realize (call it pre-interview fear I guess!) that they might not like this, because he doesn’t have a residence in the US.

Of course we do have a place to live once we arrive, but he currently lives in Argentina with me, so… we don’t know if that’s a good or bad thing!

Has anyone been in this situation?

Thank you! good.gif

no no no you should not have any issues regarding this matter as you have all proof that the relationship is real o one thing who is filling out you affidavit of support because you do need someone else than him to sponsor you I believe because that person has to show that they can currently take care of you in the US once you arrive and if he is in Argentina with you I am guessing he does not have a job either in the US yet..

A part of the interview may be him proving that you guys have made serious and substantial plans for moving back to the US. This is often referred to as "intent to reestablish domicile" and it usually a part of spousal visa questions if the USC lives abroad but I would think the same applies for K-1. If you have a place to live in the US, or have travelled there to seek jobs, have a job offer, stuff like that, that is what they may ask you about. Make sure he has been filing his US taxes too! :)

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!
