Hey folks...in about a month, my hunny should be on a plane to the USA

From plane flights I have looked at, her POE will probably be Detroit

I remember they pass out forms for everyone to fill out while on the plane

What will she as a K1 visa carrier be required to fill out? anything? nothing?

hey all people flying to the us have to fill out a blue form, the customs declaration. (only one per family, if all have the same last name)

they used to have a green form for people visiting on the vwp. not any longer

there also used to be a white form, the i94. as an effort of the 'paperwork reduction act' this form as well has no longer be filled out.

so in short, only the customs form will have to be filled out and taken to the poe.

all the best for your marriage!!!

Just the customs declaration. I-94 isn't handed out anymore, get a stamp in the passport as you clear POE then download the I-94 from the CBP website later.

As a K-1 visa holder the I-94 is needed to show your lawful status in the US. It is also the date you must get marreid by. Once married you need a copy of the I-94 to file with the AOS (Adjustment of Status). You also need the I-94 along with the K-1 visa inorder to get a SSC while the I-94 is still unexpired (you have until about 2 weeks before the I-94 expires to apply for a SSC).

The old paper form was completed on the airplane and you handed it to the immigration inspector. The inspector stamped the I-94 and made some notations on it and either handed it back to you or stapled it into your passport. When leaving the US, you were to turn in the I-94. A K-1 visa hold does not leave the US, so they submit a copy of it with the AOS package and if you happen to have an interview they take the I-94--not sure how they handle the new electronic form at the AOS interview.

So you need a copy of the I-94 for later in the journey, plus it is a way to make certain your information was entered into the CBP system correctly which will get moved to the USCIS's system.

Good luck,

Dave

Old form is obsolete. They were stamped and dated at POE then stapled inside the passport. Now they stamp and date the passport.

The I-94 is needed to get the SSN, unless you wait until after you have the EAD or GC. The I-94 is needed for AOS also.

Here's the link to download the I-94 later: https://i94.cbp.dhs.gov/I94/request.html.

We just went through this so I'm sure this is the correct way to go. The customs declaration form will be the only thing your fiance has to fill out as well as handing over the packet she should be carrying.

Make sure when she arrives she asks an immigration officer (usually there is someone directing traffic) where to go before getting inline, since they may send her to a specific officer that handles the K-1 entry.

Journey so far:

09/14/2012: Sent I-129F Packet

09/21/2012: NOA1 Received

04/22/2013: NOA2 Notice of approval
05/08/2013 NVC Received

06/01/2013 Packet 3 Received

06/04/2013 Packet 3 Sent

06/10/2013 Packet 4 email received

06/27/2013 First Scheduled interview-cancelled (didn't get notarized paperwork in time)

08/12/2013 K-1 interview passed!

08/28/2013 Lili Arrives in the U.S.!!!

10/04/2013 Marriage!!!

03/26/2014 AOS Approved!

04/02/2014 Received GC

That brings me to another question

She cannot get a drivers permit without a SS card I believe..?

So......are we saying that she HAS to wait till after marrying to get the SS card...and the SS card has to come after the AOS?

We are set to marry on Oct 20. How long do these steps take (trying to time how long until she can get her permit to drive)

No you do not have to wait until married to get the SS card. You need the I-94 and the SS-5 form (I believe that is the form), passport and any other documents listed on the form as required. Go to SSA after 10 days of POE and apply. You need to have at least 2 weeks of validity remaining on the I-94 also when applying.

Really depends on how well trained the SSA people are at your local office. Yes, you are SUPPOSED to be able to apply for a SSN in the married name usin gthe K-1 visa, but there are those SSA people who believe once you get married your status changes. If they give you a lot of grief about being able to apply in the married name, I would just leave and come back another day and apply in the visa or maiden name. You could also write the main SSA an e-mail describing the situation in detail like date, time, persons you spoke to and what they said.

As a K-1 visahold you are allowed to get a SSN based on teh K-1 and an unexpired I-94. As a person with a SSN you can use a certified copy of the marriage certificate to change the name, SOme SSA people will do this as a two step process which means they will use the maiden anme to verify immigration status and then use the mariage certificate to do the name change and yo get a SSC in the married name--that is how it is suppose to be done. Too many times they are not well trained and will feed you a whole lot of BS. Sometimes even the supervisors are not well trained. An old VJ memebr "I'M GONE" used to work for the SSA and had lots of good advice on how to handle the SSA workers. You can use the advanced seach feature to find his posts or maybe this link will work.

Good luck,

Dave

Not sure if it will delay other things, but I've heard its a good idea to wait if you are concerned with the name change.
