hey folks,

Greetings to you all! We got our interview date. Ryan is about to mail me his docs and I am about to get my police certificate and things done! YAAAY! interview is October 8th.

the church we want to get married at has available spots only for January. It's a beautiful place I've wanted to get married for a long time. However, January might be too late for AOS. Do you think, getting "legal" marriage certificate might be enough for AOS? I know, sending beautiful pix from the wedding is a definite plus I am sure of it. or should we go ahead and look for a different church or spot and get married earlier? what do you guys think? when we apply for AOS, does our application need to get there before 90 days are over? or are we going to be ok, as long as we show that we got "legally" married before 90 days are over? We don't want to get married at a different spot, unless that's what we are going to have to do, but we already planned everything and our friends that are going to help us with the wedding are also in that town/church!

K1 visa is valid for 6 months, your fiance can fly to US within that 6 months, and when your fiance arrives in US, you have 90 days to get married counted from first day of the arrival, then you can file the AOS anytime we want but sooner is better. That 90 days is only for getting married.

WOW! really????? i thought you have to apply for AOS within 90 days. that's awesome then! :) :) what about applying for a work permit and getting the driver's license? sorry i am sure these questions were discussed in other threads. :/

It's best not to make any plans until after you actually arrive in the US unless you can cancel any reservations without penalty. Even if your visa gets approved it could get thrown into advanced processing (AP) which can last months. It's not likely that this will happen but it does happen. That's up to you though - many have done it with no problems.

You can file for your "work permit" or Employment Authorization Document (EAD) at the same time you file for AOS. In fact, if you file for your EAD at the same time the application fee for the EAD is waived. As for a driver's license, it is usually based on your legal presence within the United States - either your I-94 (90 days), EAD (1 year), or green card (2 years). I had to wait until I received my EAD before I could get my driver's license. Your state may be different it's best to check on their website.

You can file for AOS at any time. It does not have to be within 90 days. Overstay is forgiven for spouses of USC's. If you left the US prior to filing for AOS you would incur an overstay for each day after the 90 days you have to get married on the K1.

Thank you Duke and Duchess. so in average how soon after getting married can I start working, i mean how soon does EAD get approved, cuz I don't like being idle :/ I know it sounds weird, people were saying to me, you'll get to stay home, be a wife. LOL. which i don't mind at all, but I actually kind of do have a job offer already at this company, but obviously i can't start working until after I get my EAD right? how doon did you get your EAD approved???

cuz my babes and I would like to maybe move overseas for a little while again as soon as he finished paying off his loans. but we'll see. cuz getting permanent residence means I would like to reside in the States, so we are still not sure about moving back overseas or stayin in the States forever... in either case, we gotta work and pay off some debt!

reservations weren't made yet. it's very good to know that AOS can be done anytime together with EAD. :D

The last I checked EAD was taking around 90 days to approve. Mine took a little less than that and we had an RFE. They approved my EAD about 2 weeks after we responded to the RFE so I probably would have gotten it sooner had we responded to the RFE faster.

If you would like to work quickly you should get the majority of your AOS packet put together as soon as you arrive. It's kind of nice having something to take up your free time!

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
