Hi,

I have been trying to figure out if my husband needs permission from the Egyptian military to immigrate to the US. He is 28 and was discharged after his year of mandatory service. He told me his service is finished unless there is a foreign war which would mean he would be put in active service again. Although, he also told me if that was the case he could apply for travel permits.

So, is there anything that needs to be done? We are awaiting i-130 approval and have an expedite approval. I'm just trying to figure out the loose ends.

08/15/13 - Called USCIS for expedite request.
08/16/13 - Sent emails to both state senators and mailed a letter to state congressman.
08/21/13 - Call from congressman that letter is being forwarded to a different congressman. Mailed letters and evidence of situation in Egypt to senators
08/27/13 - Was told the congressman's office would make an inquiry about our expedite.
08/29/13 - Received e-mail that my congressman's office had filed their own expedite on our behalf on Tuesday and would notify me when they hear anything from the NBC.
08/30/13 - NBC responded to congressional inquiry. Could not give a date of predicted approval, but our inquiry was handed over to the expedite team for review and a decision.
09/04/13 - EXPEDITE APPROVED!

If your husband has served his mandatory military duty and is discharged from the military he may still be recalled for a period up to 21 days at a time for the next nine years. If he is out of the country during a recall and can prove it then he is fine.

All he needs from the military for immigration purposes is his discharge papers from the mandatory military duty and his "free to leave the country paper".

Ok thank you. I will ask him if the paper he has states he can travel and if not have him get the required paperwork.

He just needs his military certificate. My fiance completed his one year of mandatory service just like your husband and all he had to show at the interview was his original military certificate proving that he completed his service. The previous poster is completely right, he can be recalled at any time. My fiance was recalled in the middle of our visa journey and had to go back for two weeks of service. I am not sure how common it is for someone to be recalled after completing their service but it is definitely a possibility.

That's what it's called, military certificate. I couldn't think of the terminology. Your husband should know where to go to get it too, but he may already have it as my husband was issued it upon completion of his service. After they get the ""visa in hand" is when they need to go back to the military in order to get "the free to leave the country" paper.

My husband's unit was also recalled during the revolution and the time of turmoil. He was in the USA at the time so when he goes back he'll have to prove that to them and be cleared in order to be able to leave again, or he can just show them his US citizenship provided he has it in time when he travels back there and then they can't touch him anymore.

I talked to my husband and he knew that he would need to get permission once he had his visa in hand.

He is sending me his military certificate and other forms once our i-130 is approved. We got an expedite approval so we are hoping it will be soon!

Expedite approval? What is thatttttt... How long ago did you send your I-130? I'm going on two months now.. still no approval.

What is this expedite approval thing?? And is it only good for IR/CR1, or can it work for K1 as well....

**Adjusting from initial Q1/changed to B1 then overstay, termination of removal proceedings**

(STAND ALONE i-130/TERMINATION OF REMOVAL)

First met: Totally random by asking for directions, June 2014 while on vacation at Disney World (L)

Engaged: Aug. 21, 2014

Married: Dec. 1, 2014

ICE phone contact: sometime in early Dec. 2014- Co-operated, retained attorney who advised the same.

Filed stand alone i-130: January 2015 (VSC)

ICE home visit, schedule time to go to DHS office and NTA issued, date TBD, was not detained and released on own recognizance within an hour: January, 2015.

NOA1: Feb. 20, 2015.

Transfer to CSC to balance workloads: August 2015

1)First Master Calendar Hearing: Sept. 9, 2015-Continued based on pending i-130, new court date in 6mo.

Congressional Inquiry: Dec 8. 2015

***i-130 APPROVED WITHOUT INTERVIEW: Dec. 21, 2015** :dancing:

2)Second Master Hearing: March 9, 2016- Removal proceedings terminated w/o prejudice based on approved i-130!! Remanded to USCIS to begin AOS process :dance:

Inquiry about case status: Sept 2016- Case pending interview at local office.

Inquiry about case status again: Oct. 2016- Due to factors not related to your case, anticipate a delay in processing
