getting ready for part 2..aos for my wife..do i need to send birth cert..

hello out there in visa journey land....its been a while but im ready now to do aos for my wife and daughter...getting the funds together...all paperwork is almost done...but my wife is saying that i have to send my original birth certificate? and she said my original? soo i bet her dinner and movies that i dont...i only have a copy of mines im the usa citizen by the way?we are doing aos for her that i know they need hers and daughters and translated...any info would be helpful...when i did the 129f paperwork i did include my original birth certificate so im thinkin they should have it on file...thank you visa journey....

You won the bet! If you are the USC and she is the one who is adjusting, you will need a copy of HER birth certificate along with an english translation, NOT yours. From the AoS package the only thing you need to work on is on the i864 and send all the support documents

By the way, just FYI, I notice that your wife came here on january of 2012, so her i94 is WAYyyy expire. She can get the advanced parole during her AoS, but should not leave the country. Because you waited so long to adjust, her time after her i94 is considerer as an overstay, even worst in your wife's case cause her overstay is more than 180 days. This is not an issue to get the green card, but make sure she doesn't travel abroad until her residency is granted

Although it does not mention it in the AOS paperwork, it is a good idea to send a copy in my opinion. Better to provide more than required to avoid any unnecessary delays. Here is a post from a friend of mine who currently received an NOID:

My wife sent our paperwork in April without it as well, since it wasn't noted as a requirement. We are waiting to see what happens next. Good luck!

hello out there is visa journey land...thanks to all for the info...i would like my steak cooked well done..lol ...she lost the bet but i will still pay for dinner wiat till she sees the forum...i know its way over do to get done and i know she cant leave the country for any reason and if she does thats it..were gonna have a big problem...it took me long to get all the money situated..im just going to finsh i-864 and papers are in the mail hopefully within 6 months were done......thank you visa journey this site is awesome and thank u to all that have helped and repiled have a great day and good luck to all in there journeys...
