NBI different name spelling

Hello;

My finance has an interview 8-19-13. She told me today that she's worried, because a long time ago, we had filed in 2008; for other names she gave me a slightly different spelling of her first name. It's jellie, but she said also Jelly. So I put that on the petition from 2012 also, as I sent in the I-129-F. Then when she got her NBI, she didn't include the added spelling. I believe she or her family hardly ever used the name. It's just something that when I asked a long time ago, she gave it to me, but apparently when she got the NBI, she didn't include it. Any advice on what we should do?

Hello again;

To add to my post, I'm wondering if we go ahead with the interview, if they turn us down over this, will we be able to get another NBI, & then do another interview, or should we think about cancelling over this now. It's really hard to think of cancelling over this added name spelling, but she just noticed it.

Hello;

I just talked to her, & she says, that name hasn't been in use sense the 4th grade. They say anyone older then 16 needs a police clearance, so maybe we're ok, sense she hasn't used the name sense the 4th grade. It was spelled Jelly on her baptism certificate, & she didn't have a birth certificate. So when they got the birth certificate, they corrected the spelling.

If her NSO birth certificate is different from her official ID, she has to get another NBI with AKA. Interview would proceed but she will be issued 221(g) for a new NBI with AKA. That's what happened to my fiancee her birth certificate shows CASTILLIO, but always used CASTILLO as her name on all her gov't id and phil.passport. You might want to transfer to the Regional Forum - Philippines....plenty of help there. Best of luck to you.

Has she officially (ID, legal documents, etc) used any name other then what is on her birth certificate?

If she has used a name different than on her NSO BC she may need an NBI with an AKA for other names used.

Being you are short on time, attend the interview with the NBI you have, if the CO requires a new NBI with the AKA then request it ... NBI has a liaison person that will carry the new NBI to USEM (once a week I believe) so they will handle delivery, don't think you need to pick it up and take it to 2GO like with other documents.

Hello;

Well, my finance's interview was postponed because of the rain & government shut downs in Manila; My question now is according apparently her name was on her Baptismal certificate, as Jelly; then later in life when she finally got a birth certificate, she got it as Jellie; & also corrected the baptismal certifcate. She only dealt with the name Jelly, before she was 16 years old, but when she got her police clearance, she didn't include the name Jelly. Should we just go to a rescheduled interview with the police clearance we got, (especially because Jelly wasn't used after 16 years of age & they require police clearances for 16 or older), or should we take the time/money, and get another police clearance.

You don't need a local police clearance (it is not a asked for by the embassy), you only need the NBI. Police clearance is for IF you were 16 years of age or older and lived in a foreign country for 6 months or more.

For the NBI as I suggested in your other posting about this.... order an NBI with her legal name as on the BC plus an AKA FOR any names she legally has used.

Nicknames don't count.

My wife had a misspelling on her birth certificate, that had been legally corrected years before. At the interview they delayed her visa and made her get another NBI, with both the correct and incorrect spellings of her name..

I don't know, this seems to suggest if they want to be strick about it, even the nicknames should be given for the clearance.

4. NBI CLEARANCE (Green Form): Applicants aged 16 years and older must have a valid Record Clearance (for travel abroad purposes) from the National Bureau of Investigation (NBI). Clearances should be in the applicant’s current name, birth certificate name, maiden name, married name, and any aliases or nicknames ever used, including different spellings of all names ever used. An official letter of explanation from the NBI is required for any notation of “No criminal record”, or "No pending case”. For immigration purposes, an NBI clearance is considered valid only for one year from the date it is issued. You may contact NBI at (632) 523-82-31 to 38. The NBI website is http://www.nbi.gov.ph.

Dave E, how long was your wife's visa delayed? That's kind of what I wanted to find out. If it's a long time then, maybe I should get another one to be safe; if it's just as long as it takes to get a NBI, then maybe we could take our chances, & not bother, until directed to do so.

My fiancee finished her interview and was given 221(g) for NBI with AKA and still waiting HK police clearance. She went to main NBI on U.N. Ave. with the original NBI and after payment and coding went to 3rd floor (OFW), and be ready to give "early x-mas present" to the person that will help you. Explain and show your present NBI and that you need another one with AKA. She was told to wait and be back at 4 p.m. and it was ready. In the 221(g) she was instructed to proceed to any 2Go office with the new NBI with AKA (still travel abroad or travel to usa...green form) and attached a copy of 221(g) and 2Go will deliver to the US Embassy free of charge. She went to Robinson's Mall. She was given a tracking # and after delivery there was a txt confirmation of delivery to an embassy personnel. Presently we're still waiting for HK clearance which arrived Phils. on 8/2/13, but embassy is not in receipt of it yet. That's a whole lot another issue we're dealing with. I've emailed HK and they provided tracking #. Seems HK clearance is lost/misplaced/never received. Grrrr!!! That's where we stand right now. And embassy being closed for 3 days, really have to wait Thursday or Friday to contact them again. Hoping for a better results.
