I just called USCIS and they confirmed that K-3 is still available. Also, you can check this info at http://travel.state.gov/visa/immigrants/types/types_2993.html.

When you want to go the K-3 route, make sure you send your I-130 first and wait for your NOA. Then, you can send your I-129F.

"How will the Department of State process my K-3 visa petition?

Important Notice: Effective February 1st, 2010, when both the I-129F petition for a nonimmigrant K visa and the I-130 petition for an IR-1 (or CR-1) spouse of a U.S. citizen visa have been approved by USCIS and sent to the National Visa Center (NVC), the availability as well as the need for a nonimmigrant K-3 visa ends. If the NVC receives both petitions:

* The nonimmigrant K visa will be administratively closed.

* The application process explained below will not be applicable and cannot be used.

* The NVC will contact the petitioner and you with instructions for processing your IR-1 (or CR-1) immigrant visa. For more information on the immigrant visa process review the Immigrant Visa for a Spouse webpage.

If the NVC does not receive your I-130 petition and I-129F at the same time, the NVC will process your I-129F petition. Then NVC will send the petition to the embassy or consulate in the country where the marriage took place. If your marriage took place in the U.S., the NVC will send the petition to the embassy or consulate that issues visas in your country of nationality. If your marriage took place in a country that does not have an American embassy, or the embassy does not issue visas, the NVC will send your petition to the embassy or consulate that normally processes visas for citizens of that country. For example, if your marriage took place in Iran where the U.S. does not have an embassy your petition would be sent to Turkey. "

beedee15- this was also my understanding... My husbands I-130 was just approved a week ago (took nearly 3 years!) and all along I thought, according to the uscis and dept of state websites, that I needed to WAIT for the NOA1 to send the I-129f. So, now that I've waited for three years outside of my home country of USA and his I 130 is FINALLY approved- NOW I should file the I129f, right? OR I can elect to apply for the IR1/CR1?? SO confused at this point! lol I am a law graduate and I "get" the jargon well- but the immigration process- complicated as hell... I HIGHLY RECOMMEND USING AN ATTORNEY FOR THE SPOUSE VISA PROCESS (OR P.R. PROCESS- WHATEVER! LOL) by the way- anyone know how long it averages from NOA1 to embassy to schedule interview? how long does THAT paperwork take to transfer... 3 more years?? [yes I'm very frustrated LOL]

ahhhhhhh dammit! I just seen that you posted in friggin 2010!!! :-o now what.? Any news or advice to offer since then? smile.png

You've just replied to a 3 year old topic.

I'll ask the mods to break off your post into a new one. NOA1 was the notification the USCIS has recieved your I-130 package. if it's approved (NOA2) you cannot do the K3 route.

Okay you or the beneficiary needs to be calling the NVC (see this thread - read all the posts in 1&2) to get case and invoice id numbers. That way you can submit payments and documents so the beneficiary (who becomes the principal applicant) can get their visa! :D

If your I-130 was approved, it is too late to do the K3 route. The approval notice is NOA2, not NOA1.
