I'm an American citizen resident in Italy with an Italian fiance. I'd like to get married in the US, but don't want to move there immediately. My idea was to get married in the US, return to live in Italy, and, a few years down the road, I'd like to apply for the K-3 visa, but I was told that by entering the US on a tourist visa and then marrying, my fiance would be in trouble for visa fraud (as this shows intent to remain in the US). Is this true even if we have round trip tickets from Italy?

nope. is ok to marry in the USA whilst on the VWP.

It's NOT OK to adjust status in the USA after the marriage.

Entering the US on tourist visa (or VWP) to get married is OK

Entering the US on tourist visa (or VWP) to get married with the intention to stay and AOS is no OK.

Yes, you could enter US to get married and leave.

Remember to bring evidence/documents (employment letter, apartment/car mortgage ..etc) to prove ties to home country.

K-3 is obsolete. IR1 (for couples married for more than two years) or CR1 (for couples married for less than two years) is the way to go.

Done with K1, AOS and ROC

Agreed... You can go get married in the USA, then when you are ready (actually plan for filing 8-12 months before if you want to minimize time apart) then file for CR1/IR1 visa... No k3

11-30-09: GOT GREEN CARD in mail!!!!!!

Citizenship Process;

1/11/2013: Mailed N400 to Dallas Texas

3/11/2013: interview.. Approved

4/4/2013. : Oath! Now a U.S. citizen!
