She has remarried (which I thought released me from my affidavit of support obligation) which I believe now that it does not. But I heard through a friend of a friend that she might of become a U.S. citizen. Where can I go or call to find this out?

the only way to know is to go and acually ask her or ask somebody who is clooooooose to her. USCIS and any government agency won't tell you about her at all. Good luck.

If you are filing again enclose her information and they will figure it out if they care to. The only effect it has is you ability to sponsor. Assume she is a USC add her info in an ademdum and make it their problem.

This will not be over quickly. You will not enjoy this.

At the advice of my attorney back then, strongly suggested my wife file a I-864A where she assumes equal responsibility. She didn't object to this, a sign of equality when entering into a marriage.

Do you feel like you are the victim of fraud in your case?

One thing I couldn't help but notice with the USCIS as an overview. They are far more interested in hanging a sponsoring US citizen, then helping them.

I called about this same thing yesterday. The lady at USCIS told me that I too still have responsibility of my ex-husband and to include him in the household. She also told me he could fill out and I1864 as well and include him in the earned income. I can't get a hold of him and if I could he probably would but I doubt he will make this easy. I know he is about to become a US Citizen since he is joining the Navy in November and the military expedites the process so it will be rather quick, but I really don't want to wait on doing the AOS until this happens. I'm lost.

How long ago was it filed. The other stipulation is 10 years of Working and paying into Social Security will also remove the liability.

The sponsorship obligation continues until the sponsored alien naturalizes, has worked or can be credited with 40 quarters of work, leaves the United States permanently, or dies. However, a sponsor or the sponsor's estate remains liable for any support or requests for repayment of benefits that arose before the support obligation ended.
Does divorce nullify the sponsorship agreement?
No, divorce does not nullify the sponsorship agreement.

NOTE: Actual sent date unknown due to lawyer negligence - I delivered ALLForms and PAID Lawyer on Nov 7, 2012 - Lawyer kept saying he sent the packet and USCIS must have lost it. When in reality he failed to send the package and only a new copy to USCIS after I made a legal written demand giving him 10 days to perform or return ALL monies paid to him, due to "non-performance".

(IMO it's better to save your money for visits to or from your Fiancé and just fill it out yourself using the K-1 Guide on VJ and Senior Members... They Rock!!!)

Yes that is exactly what I was afraid of. So I will have to wait until I find a co sponsor he becomes a citizen or I get a raise. lol Whatever God blesses me with first I'm fine with it.

Concerns, I had is if my spouse or stepchild became permanently injured and kicked off my health insurance policy, even if it wasn't their fault. In speaking to attorney's on this issue. If the culprit has no insurance, in brief, you are screwed in the event of a so-called accident.

Yet another, this country may move your job to China. Corporations weren't permitted to do that until our government changed those rules, nor were hostile takeovers permitted. Then there was that crash five years ago where many lost their jobs, the hard working people of this country, not the billionaires that caused it.

While we did apply for US citizenship at the earliest possible date, wasn't due to that I-864, but was due to the USCIS super dragging their feet in that crazy ROC stage

Then what happens with the I-864 immigrant, that just married you to come here, then ends up screwing you blue? Often made the comment if they read our states divorce laws, would have never married my ex in the first place.

Here are some common defenses:

  2. The Intent of the Sponsored Alien. The sponsored alien never intended to enter into a lasting marital relationship, but was merely using the sponsor to gain immigrant status. If the sponsor can show that the alien committed fraud, this is a complete defense to any future liability."

Ha, I got to wonder about the first when I was drafted, if I didn't take the oath to defend my country, would have been tossed in prison.

In the second case, depending on the state you live in, with that intend, the marriage contract never existed in the first place, therefore liability does not exist.

So far, have found nothing if the immigrant remarries, but do know, if they do, no longer responsible for alimony payments, seems like a contradiction.

But they are sure making the death of that prior spouse an attractive option. Wonder what idiots made all these laws?

This makes me just want to move to the DR (Nagua) and live happily ever after. But money is difficult to make there. Any ideas?

Yes I did do the K1 and would of been denied had they asked for the I134. Lucky there I know. Just keep faith and look for anyone willing to help co sponsor. Good luck and I'm sorry. Also moving to Nagua would be great for a minute but there you waste more money than you make!

LOL. You are sure right about the spending part. I found out I make enough $$ no co sponsor needed. Just bought 2 airline tickets this morning for october and november.
