I am going to send I-129F with other documents for K-1 for my fiance who currently lives in India. Do I need to send the copy of my fiance's bitrh certificate along with I-129F.

I checked the check list in this web site and it is not part of the check list. But one of my friend who had applied K-1 for his fiancee told me that it would be better to send the copy of my fiance's birth certificate. Please let me know whether to send that or not.

No, you do need to send your birth certificate with the I-129F package, but the beneficiary's certificate is not needed in the package.

You will need the beneficiary's at the visa interview.

Check the guide, it lists exactly what is needed to be sent to USCIS with the I-129F

Whilst it is not a requirement of the I-129F to submit the beneficiary's birth certificate, it can be beneficial and does no harm to do so.

I agree it's better to send it. For one, by getting the BC you will make sure that the beneficiary has one! Also, it will help make sure the spelling of the beneficiary's name and the birthday is correct on your forms. My lawyer recommended it, I didn't understand why, but I agree.

By all means send a copy of the beneficiary's birth cert. Recently I have seen some members get an RFE for a copy of the beneficiary's birth cert. The guides here don't list it but they should. Anything you might get an RFE for should be listed in the guides IMHO.

My fiancee is from India too. My lawyer did submit her birth certificate with my I-129F. But you will also need to submit it at her interview or with packet 4.

I think if you haven't heard by now you are probably ok but I am not 100% sure. When we got our RFE for the birth certificate, it was under 2months later. However if you do get it there is not much you can do about it except send it on straight away. Also, if you are from an english speaking country and they ask for a translation, they simply mean a translation for the birth certifiacte if needed. Hope it goes well :)

Don't be stressing over this. The majority of petitioners do not get an RFE for the beneficiary's BC. :)
