NOA2 received... question regarding delaying

Hello hi, good people of VJ!

So my fiancé and I received our NOA2 on Aug 2nd! It is a good news, obviously, but our circumstances make it harder to really enjoy it. My love resigned from his US Army chaplain job last June and is currently looking for a call as a pastor. While we trust something will come along eventually, he is currently jobless - and homeless... living with me here in Canada on a temporary visitor visa (he can stay here up to 6 months without problems).

There is no way his little savings could make up for his current job situation, and we have no options as far as co-sponsor go. This would not exactly look good on an embassy interview, and therefore, I am thinking we might have to delay my appointment with Montreal. Now, my question is regarding exactly HOW LONG one can delay an interview. I remember asking and someone said the NOA2 was "open" for 4 months. What if it takes longer than that for my fiancé to find a new job? Can we delay longer? And if we have to wait too long, does that mean we would have to reapply for a I-129F? Would we be less likely to be approved if we had to refile in, say, a year from now?

Life is stressful business, let me tell you that! But the visa process mixed with job seeking.... arg!!

Any advice will be greatly appreciated!

My goodness. Tough situation. Hopefully he finds something soon...

May I suggest calling the consulate in Montreal? I'm sure you're not the first Canuck to have to delay the process (I may be doing the same thing with Vancouver due to a slow house market - house isn't selling!!!)

I think many hunny-bunny filers could be in the same situation.

As I was too, earlier, looked up for some information.

You are right, the approved petition is valid for 4 months.

The date is written on your I-797(NOA2). In your case it should be valid until 1st December.

Then, to extend the visa application, a US citizen need to write a letter to the embassy to explain it, in Tokyo.

It could be country specific so you'd better contact Montreal as pro_star suggests.

Don't worry. You have still plenty of time to prepare!

To revalidate your petition, please have your U.S. citizen fiancé provide you a letter, requesting that your petition be extended to a further 4 months from the approval date of the I-129F petition. This letter must be dated and signed by your fiancé.

The letter from your U.S. citizen fiancé(e) should state their intention to still marry you within 90 days of your arrival into the U.S. with the K-1 visa and that you both are still free to marry.

Please scan and email a copy of this letter to SydneyIV@state.gov

If your request for revalidation is approved your application will automatically be extended & you will not be notified, however, if it is denied, only then will we contact you within 5 business days to you to advise you further.

I think you're supposed to have your interview completed by the cutoff date on the NOA2, but as long as your interview is scheduled by then, I think it's ok. So when it comes time to pick and interview date, just pick the one that's the furthest away. That might give you a couple extra months.

As mentioned the petition is only valid for 4 months, BUT the embassy can extend that validity up to a year, 4 months at a time... just call them
