Hello Folks,

I have a question. We are in the NVC Stage and have questions if we do really need an additional sponsor.

Background - My wife ( the petitioner) is in the process of submitting my AOS. She was a student until May 2013 and graduated in June 2013. She recently has got a job as resident doctor starting from late June 2013 with an average yearly salary of 52k USD. She did not file taxes for the past 3 years or even earlier, as she has never had any income. She falls under the IRS guideliness for Publication 501 that she was not required to file taxes as filing status single, less than 65 years of age and income less than 9750 per year. She also have no savings, may be 1000 USD as she just started working and has started to pay off her loans and cover her expenses.

Question - Do we really need an additional joint sponsor (another i864) or household member (i864a) ? If my wife just fills out the i864, on the i864 mentions that she did not file taxes, and attaches the reasoning in the cover letter of why she did not file taxes, attaches the extract of the publication 501 from IRS and also submits a copy of her new employment letter, stating her salary and copies of her pay stubs. is that sufficient ?

Help would be appreciated?

It may, and it may not.

NVC is more facts, so they may look at your current pay stub and approve the packet, however, at your interview, they may deny.

The final word is your approving officer at interview.

You should have a joint-sponsor lined up just in case since you're cutting it REALLY close.

Make sure she also brings more up-to-date pay stubs to interview as well.

No one can really give you a for-sure answer since it's complete up to the discretion of the approving officer.

Everything else you plan to provide due to lack of tax history is correct.

nvc is rather lax about tax stuff - it's the IV Unit that will adjudicate her AOS set on interview day.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

This poster has posted before... Is going through Montreal, just to note. I suggested they try with just the wife's I-864 and if needed add the SIL as a joint sponsor with an I-864 not the household member I-864a.

The interview won't be until at least September or October if they finish up in July or Aug as well, that gives more time for the wife to be working at her job.
