Greetings All,

Here is the URL for determining the Poverty Guidlines to determine salaries required for I-134 and I-864.

Remember the numbers reflected are for the I-864 which is 125%.

I-134 is 100%

Please keep in mind that some dates are only known after receipt of another document.
For example, the USPS Form 3811. The stamped receiving date was not know until the original Form 3811 was received on 07/13/2013 1:30 p/m CST.

It is not that simple. Many of the consulates still require the 125%, even with the I-134. Everyone needs to research and find out the amount the consulate they will interview at wants to see.

Your flag is the Philippines. It is my understanding that Manila is one of those consulates that requires the 125% for the I-134.

How do you use the Poverty guidelines? if you are part of an 3 membered family and is still still living with them plus the benefeciary which makes it 4, your fiance should be earning base on the 125% poverty line 24,412? is that how it should go? Household size is not based on who resides together in the same house. If you live with family members that are not your dependents, then they are not included in your count size and their income is not used for the I-134. Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, any immigrants previously sponsored with an affidavit of support whom you are still obligated to support plus the foreign fiance(e).

Hello everyone i have some questions about the affidavit of support.

last year i was out of the country , i dont have my taxes from last year therefore i will have to use a joint sponsor "my father" but three years ago he applied for my mom and she still depends on him financially, i would like to know if he can be the sponsor having one dependant already. He is making aproximately $34.000 a year, is this enough? should i fill one too even if it's blank or is enough with his?

Does that mean GROSS PAY before taxes or NET PAY after taxes? Because right now I make above the 125% mark if it's gross pay, but under due to the taxes taken out of my paycheck.

It's based on adjusted gross income.

It is not based on adjusted gross(AGI), as stated above. It is based on your gross income, before taxes. So, if you make $15 an hour and work 40 hours a week, then you multiply your weekly income by 52 weeks to get your current annual income of $31,200. Use a letter from employer and/or most recent pay stubs to prove your current income amount. Also provide a tax transcript for your most recent tax year, which is now 2013.

If you are self-employed, then you will use your tax transcripts to prove income and it will be based off of your Total Income, which is line 22 of the 1040. On the IRS transcript, just find the line that states Total Income.

It is your current plain old gross income. Not your adjusted from last year's taxes. It is never the AGI anyway, unless you use the 1040EZ. If your income meets or beats the 2014 guidelines, then you are good and do not need a co-sponsor, especially if you show stable ongoing income with the documentation I listed above.
