Hey guys, I am new to this forum and I have a quick question,

My hubby will be eligible to apply for citizenship by April 2014 ( 90 rule, he migrated July 2009) however while reading through the application we realized that he was suppose to apply for Selective Services but didn't. Will he get automatically be denied when he applies for Citizenship because he didn't registered? Also I read that if you apply for your driver license they automatically register you for selective services, is that true? Because he got his license a couple months ago before tuning 27 so I am wondering if they registered him.

Just some back info he migrating from Jamaica to New York in 2009 at the age of 23 and he is now 27 years old.

P.S OMG I wish I found this site years ago. My hubby and I have been together for 7 1/2 years from 2006 and married for a 1 year and half and we were here thinking it was best to wait for his Citizenship to file for me but while reading here I now realizes that if we had filed years ago I would have most likely migrated already because it would have taken 2 1/2 years as a LPR smh.

How exactly did he enter the US? He may have been automatically registered for Selective Service if he entered on an immigrant visa or obtained a green card through adjustment of status.

You can try to check online to see whether he was automatically registered: https://www.sss.gov/RegVer/wfVerification.aspx although even if it fails he may still be registered, you would just need to call and have them check other records not available through their online system.

Worst case scenario: if he absolutely is not registered for Selective Service, he would not be able to file for citizenship until he turns 31.

Thanks so much for replying.

He entered the US through a I-130 petition filed by his dad for him, his mom, sister and brother.

We will definitely check the site to see if he is registered.

Why if he is not registered he has to wait until he is 31?

Because as part of the background check for the N-400 they pay particular attention to the previous five years of your conduct. Not registering for Selective Service when you were meant to fails you under the "good conduct" requirement, but once that "drops off" your record after five years then it stops being something that can prevent you from naturalising. Therefore, once the requirement to register ceases (when you are 26) you add on five years (when you turn 31) and it stops being a barrier.

It's when he turns 26, not 27.
