Waiting for NOA2 since Feb,2013

Hi, my spouse & I married over seas in January. She returned home to NY & filed I130 in late January, received email of USCIS Acceptance Confirmation on February 1. Got the letter I-797 (NOA1) a few days later. Since then we've just been waiting. I live in Canada & my spouse is in New York. We called USCIS on a telephone conference call and spoke to tier2 agent last month and he kept saying "It takes 5-8 months", when I asked if there's any problems with the application he said "no, just wait 5-8months". Looking at VJ, most people seem to get NOA2 in 3-4 months. Is everyone having this problem recently or is it just us? I think our center is Vermont (though Im not sure).

not only you.. we are december filer and still waiting for noa2 and we never heard anything from them also.. i guess we just need to be wait and wait until they approve it,. our receipt start with MSC, so we are NBC.. my husband also tired of calling the USCIS because they just keep telling what we already know.. ranting33va.gif

Thanks for sharing that. I'm relieved to hear I'm not the only one - but grief stricken to find out it's taking so long! Seems like we have to constantly delay our plans to move in & do the things we wanted to...

Make an infopass apt

Thanks for your reply. If my spouse is a resident of NYC, Does that mean our case is automatically transferred to NYC field office? It doesnt appear on the USCIS website, when we called the USCIS, the tier2 agent said its taking 5-8 months and said there is no problems with the application thus far. How can I find out where exactly my case is?

Speak with a tier 2 and specifically ask when your case was transferred to the NYC field office.

If they instantly say 'it wasn't transferred'

Ask for them to please check just to confirm.

Hopefully they will eventually sound as if they are really checking.

Then, you'll either get your answer, or they'll say no and you assume it wasn't transferred.

However, given the time frame passed, it really is an indication that it's at NYC.

So, then you could follow up by doing an infopass appt and going directly into the office and inquiring.

There's been other posts about what to ask at the appt.

follow this post for february 2013 I-130 filers

NYC has been slow you makes us 4 filers whose local office is NYC and are february filers and still waiting.

just read someone who is december filer (their local office NYC) got approved yesterday.

p.s. create a timeline. will help you track urs and helps other track how many are still pending or approved.

Thanks a lot for your prompt replies. One more question, I was looking at the infoPass website to make an appointment at the NY Field Office, it seems they dont provide the service I would need? I chose "You need Service on a case that has already been filed" and then I am asked to choose one of the following:

Services on a case that has already been filed At Case Status Online
  • You can check current case processing times to get an idea of how long your case should take.
  • If your case has a receipt number, you can check the status.
We offer 4 kinds of appointments for a case that you have already filed. Please choose from the following - Order from Immigration Court - If you were directed to us for processing based on an order from the Immigration Judge. You must bring all documents required in the post order instructions given to you by the court.

Case Processing Appointment - If you received a notice to go to your local office for further case processing.

EAD inquiry appointment - If your I-765 employment authorization application has been pending for more than 90 days.

Case Services follow-up appointment - If it has been over 45 days since you contacted NCSC and have not received a response to your inquiry. You must bring the Service Request ID Number related to your inquiry to the appointment.

Which one of the following would apply in my case? Case Service follow-up? if so, where would I get the service request id number from?

5-8 months really is the time frame an i-130 petition takes. Any longer than 6 and you can start doing service requests and making infopass appointments at the local office. People from Atlanta seem to be the hardest hit as Atlanta didn't even start working on cases they received in August until Jan. The larger the city, the slower they tend to be as well because they have so much other work they're also doing. Hope that you can get a little insight into where your case is at via calling.
