I'm 31 years old and under F2B visa application. I have 2 minor children ages 8 and 3 years old. I am never married but the last name of my children are from their father based from a lw here in the Philippines that they are acknowledge by the father as his children. M question is, can I bring them along when my petition arrives? Help please. Thank you

Yes, your children can immigrate with you. They are dericative beneficiaries of your case.

You will need to obtain the father's permission for them to immigrate.

For Philippines, illegitimate children are under the sole custody of the mother, even if they are using their father's surname and father acknowledged them on the BC.

You don't need the father's permission to immigrate with your minor children.
