Hello all! I'm a little worried here. My fiancee filed in a petition for the K1 Visa since January 2013. However, we are yet to hear anything from them as regards to the next step.I'm losing my patience as I really miss her so much and considering going for a B1/B2 visa. Anyone experiencing same or experienced ? Please I'd welcome any advice on this.

The I-129f petiton takes 5 - 9 months to be approved. All depends how busy the service centres are when your case is pending. Check your case on the USCIS website and see their currently processing priority date. If yours is before this date, you should contact them.

Doing so would most likely be an exercise in futility as it is highly unlikely you would be able to overcome the presumption of immigrant intent.

September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!
June 21, 2010: Engaged!!!
September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Although it seems to be taking a while, I believe you are still in the normal processing time frame....I would strongly suggest you don't abandon the petition and file for a tourist visa. Tourist Visa's for Nigerian Citizens are very difficult to get. You would have to deny being engaged with intent to marry someone in the states (as stated on the K-1) or else they will automatically deny you and tell you to file the K-1 anyways. However, since you've already filed the K-1 stating you have someone there with the intent to marry you can't really back track what has already been stated. The waiting is very difficult, but a little patience goes a long way!! I hope you have an update soon!!

Like most people already said,filing for B1/B2 visa will be a waste of money. I did that and was denied because according to the immigration officer,you are not allowed a non-immigrant visa if you have a pending immigrant petition. Even though I already had a previously expired American visa,they said I will have to wait to hear the result of the K-1 petition. We filed in october 2012 but didn't get approved until may 2013. Some cases are slower,some are faster. I know the wait is hard,just be patient and pray. It will come soon
