Hello my lovely VJ'ers! Received our NOA2 and boy I can't tell you how ELATED we are! Yay!

Anywho, am starting to fill out the I-134 for myself (petitioner) and working on instructing my sister (co-sponsor) on what to do.

I have a quick question so if someone could please clear up any confusion for me it would be greatly appreciated!

For question #8 I can see from the example form that I should put NONE on my form. However, I have read in other threads that on the co-sponsors form they should list their household dependents PLUS the beneficiary (my fiancé).

So, from my understanding my form would read NONE.

And my sister's would list her husband as partially dependent (they are both working and supporting the household) plus my fiancé (the beneficiary) as wholly dependent.

Is this true? Or should my sister just be listing her husband at this point?

Thank you kindly for any help goofy.gif

I think too many people are confusing dependents with household size to meet the income requirement. The foreign fiance(e) is listed on the affidavit and will be counted as part of the household size, but they are not dependents of the petitioner/co-sponsor. For #8 the person filling out the I-134 only lists their dependents, such as spouse, minor children and anyone else they claim on their taxes. The CO will add up the count to determine if they meet the requirements. So, the USC petitioner would put None for #8 if they have no dependents and their household count would come out to 2, themselves plus their fiance(e). The co-sponsor would list their spouse as a dependent in #8 and their household count would be 3, themselves, their spouse and the beneficiary.

Summary> The beneficiary is listed elsewhere on the form, and not under #8 as a dependent.

Thank you so much! This answered my question perfectly.

I have a question about form I-134 question 8 as well. My fiance has a child who he does pay child support for. It is deducted off his pay. What's confusing us is: People are saying that you write down people you claim on your taxes. His ex-g/f claims her under her taxes. So just to clarify, does he add her as a dependent on the form or not? (We are assuming so, but don't want to assume, but be sure and not make any mistakes).

In the case of a minor child, they are counted as a dependent no matter where they live, if child support is paid, or who claims them on their taxes.

How to count household size >

Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support, and any immigrants previously sponsored with a Form I-864 or Form I-864 EZ

Just as we thought. Thanks for the confirmation :)
