Timeline

Can anyone advise me on the Selective Service that it notes I need to register my husband for?

We have sent in our Citizenship package but noted he had to be registered for selective service if under 31?

My husband is 31 in August so it would appear he has to be registered?

However looking at the information it states only 26 & under "need" to register?

Any advice IF we need to do this or not?

If so I will just get my husband to register & take it to his interview.

I've only ever seen selective service listed as for under 26 year old men. This seems to be what the internet believes too: http://www.sss.gov/FSwho.htm

I was looking at the "Welcome to the USA" booklet they send out, and that also states under 26 also. http://www.uscis.gov/files/nativedocuments/M-618.pdf

I don't believe your husband needs to do anything. Do you happen to have a link or copy of the citizenship package that said 31?

Was he 26 or under when he moved to the US? If no, then you are fine. If yes, and he didn't register, then you will have a problem for citizenship.

Ah, indeed. I had read the OPs post as referring to her husband who had recently become a citizen (or about to become one).

I'm currently reading the wikipedia page (see you in a few hours), it's very interesting!. I'm finding it hard to follow the bits about aliens in the USA and their requirements to register or not.

Will the fact he never registered in 2009 when we married & applied for AOS effect his application for citizenship?

The SS website seems to suggest that not registering when you were supposed to will make a person ineligible for citizenship. However, also read this: http://www.sss.gov/FSmen.htm

But again, I've only just read this stuff myself. I have to say, the first time I came across mention of it is in that Welcome pack that people receive upon entering as an immigrant. I assume everyone receives that though, and I also am assuming visas come with conditions that explain your legal requirements.

Note how that one says that AOS automatically registered someone for SS.

I am think my husband was 26 when we married I am having a mental block he was born August 26, 1982 & we married in June 2009?

I think he was 26 at that date we married so would he be ok?

Panic setting in that we got this far & I may have missed something way back then!!

It depends what visa he was there on before AOS. A K1? If it was non-immigrant (as the K1 is), and he was there for less than 1 year then it's fine. If he was 26 when you married and he adjusted status, then it doesn't look like he'd be registered because he'd be too old at that point. :)

That link I found to the other thread is pretty much someone in the same circumstances if he was a K1 entrant (and they determined in that thread that he had not needed to register).

He was here on a tourist visa waiver prior to our wedding...which seems so long ago now!

He applied for AOS in 2009 when he was 26.

However he did not get his provisional green card until Aug 2010 when he was 27?

OK, then he's fine. :) He would not have been required to register while on the VWP, and if he *had* been under 26 the AOS process would have automatically registered him anyway.

Still hasn't cleared up the mystery as to where you read he had to register at age 31.

Thanks so much I have been in a total spin as he was 26 when we married & I thought maybe that included him.


BTW Lost-at-sea my In-Laws are in SF today they have been touring on a motorcycle around California they are in Santa Rosa now heading back to SF to fly back tomorrow

Nice! Lovely scenes to take a bike along - good choice. I'm the Brit, though - my husband was living in SF and we're relocating back there in a couple of months (although I've been quite a few times now).

I think the 31 is adding on the years it takes before one is eligible to apply for citizenship. So greencard at 25, eligible for citizenship at 28-30..would need the SS registration. Greencard at 27, citizenship at 30-32...not required to register. Not sure it's working well for marriage based citizenship that can happen three years after the greencard. It works well for the five-year plan, which is what the forms are geared toward.

I think you are correct on the 31 age theory relating to 5 years

I am much relieved that I have now found this on the Gov website when checking if he had been automatically registered.

It means he is fine as he was 26 when we married & 27 when he became a LPR.

Please someone tell me if I am getting this wrong???

Maybe we need to share this info for others when they initially become LPR as we certainly overlooked this information at that time & it could have had bad results for us now.

Male non-citizens living in the U.S. who are 18 through 25 must register to remain eligible for citizenship.
