Hello everyone!

My husband and I are trying to replace my step mother-in- law as a co-sponsor for my AOS. My husband's step father offered to sign the contract. Now the confusing part is, he is a disabled veteran. He files his taxes every year together with his wife. He gets compensation from the VA and the Social Security. He makes around $40K a year from the DFAS and SSA. What necessary documents should we submit to the USCIS? I have his yearly income tax returns (2010-2012), summary of benefits letter from the Department of Veterans Affairs and Social Security Administration. Is that enough or do we need more documents to prove that he is above the poverty guideline? His wife doesn't make enough so their income in their joint income tax does not meet the poverty guideline.

Thank you for all the help!

The summary of benefits from the VA and SSA would be like employer letters where the source of the income provides testament to the amount. It should prove it to USCIS. It might be useful to point it out with a full piece of paper stuck in behind the I-864 with a summary and explanation. That might be noticed easily as they start to flip through looking for evidence. Follow with the benefits statements, then the tax return. Don't forget joint sponsors must show proof of their citizenship or LPR status as well.

PLEASE NOTE:

Mr. Joe Smith, joint sponsor, receives the following separate income not reflected on the tax return.

$21,000 US Department of Veterans Affairs

$20,000 Social Security Administration

_______

$41,000

2013 benefits statements attached as evidence
