They sent this for Request

The Service will process your form I-765, Application for Employment Authorization (if submitted) within 90 days of the receipt of your missing initial evidence.

This is pursusnt to title 8, Code of fedral Regulations, Section 103.2(b)(10)(ii).

I don not understand this , code and How to Reply to my status, I came to us with VWP(tourist visa) and got married with US citizen.

Please anyone help me !!!!!!!!!!

Interim benefits will not be granted based on an application or petition held in suspense for the submission of requested initial evidence, except that the applicant or beneficiary will normally be allowed to remain while an application or petition to extend or obtain status while in the United States is pending. USCIS may choose to pursue other actions to seek removal of a person notwithstanding the pending application. Employment authorization previously accorded based on the same status and employme nt as that requested in the current application or petition may continue uninterrupted as provided in 8 CFR 274a.12(b)(20) during the suspense period.

Did you include the passport photos and evidence with the form for EAD?

Yes. I filed I-485, I-130,and passort photo and evrything on the instruction. thanks

I did not ask about the 485 and 130 - I asked about the form for the EAD 756 requires 2 photos and evidence. Did you send those with the form.

please post the whole notice like Darnell said. It would help a lot more.

Yes I did sent 2 photo. With evidence. But i didnt put any 8 code on form i765

I will post my RFE whole copy tonight .thank you for helping !!!!!!!!!!!!

Weird. Really want to see the letter now, will check back later hopefully you can get it posted.

This is my RFE.

This office is unable to complete the processing of your Application to Permanent Residence or Adjust status , (I485) without initial information .Submit ALL the information requested below at one time. Failure to do will result in a denial.

There it is, you skipped what they wanted.

The petitioner / sponsor federal tax return does not meet the 125%

The petitioner / sponsor did not include proof of current income, they have a list of all the items that are needed in the quoted post.

Did you have someone file the 864 along side your husband as a sponsor?

They want the proof of income for that person. - If you did not have a co-sponsor you will need to get one and include the evidence of that persons income with it.

ok - so it's the I-864 that got 'dinged'.

unsure if it's the uscitizen spouse or the joint-sponser (a 2nd human)

but

prepare what they asked for, even if it was submitted already,

and send it in.

if it was just the USCitizen's info that was sent, with 'the packet', originally, then they found his $$ lacking. Suggest he get a co-sponser or joint-sponser, nowish.

if if was just the USCitizen's info that was sent, with 'the packet', originally, and you are CERTAIN that he is above the poverty guidelines - is possible that something fell on the floor and got lost. submit another (complete) I-864.

we sent us citizen ( my husband ) info with last 3 years income Tax .so u think its ok to file the another I864 form ? just in case ?

and my husband is sponsor . we about to submit the his current income since he started working last year Aug, im not sure this is enough lol

well (lol) it is what is required,

prior year tax data

and

current annual income.

even with current annual income - it's a projection of 2013 - who can say exactly how much you will earn in 2013? it's a projection.

So, based on the RFE and based on the this I-864 packet he's preparing,

please tell us -

It was missing evidence of annual income. Becuse We filed last 3years Income Tax. With i864 from. That's it . And we filled out form with total income from 2013 lol . From 2012 income wasn't enough .So we have the evidence now so I will try with what they said on the RFE. Letter of employments... And day stub. And wage of salary and how many hour week. And prospects for future employment.
