7 month pregnant US citizen giving birth in Canada (Indian Dad)

Hi,

I'm 7 months pregnant from my boyfriend. He lives in Canada and is waiting on his paper to process for a fiancé visa. The process is taking forever and I don't think he will be here by the time our baby is born. He wants to be present in the birth so he asked me if I can just go give birth in Canada (Ontario). We plan to pay the hospital expenses out of pocket and to me is not a problem. The thing is, I'm not sure how to go about this, if I'm allowed to go have my baby in another country, what will happen when I want to bring my baby back to US.

My fiancé came to Canada in a student Single entry visa so he cannot come here until he gets his multiple entry from Canada and then go to the interview to get a tourist Visa from US so that at least he can cross the border to US as a tourist until his fiancé visa gets approved. He is not a Canadian citizen but a citizen from India.

How can I pull this off without having any problems with immigration? Will that affect my fiancé's status if they find out we are having a child born in Canada?

I need someone to orient me about this. I have no clue!

If your baby is born in Canada, you will have to file a Consular Report of Birth Abroad (CRBA) at the nearest US Consulate (or the US Embassy in Ottawa if that happens to be the closest).


Will that affect my fiancé's status if they find out we are having a child born in Canada?

May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

I would check into the cost of having the baby in Ontario. What if there are complications like the baby is born premature or if you need a c-section? Double check into those costs as well.

Also it can take a while to get a birth registered. The Ontario site is saying it can take as much as 2 1/2 months to register the birth and receive a birth certificate. http://www.ontario.ca/government/how-long-does-it-take-register-birth-ontario-and-get-my-babys-birth-certificate

After you have the birth certificate you will need to do a CRBA at the closest consulate or Embassy, so you are looking at another delay there.

That’s IF you can even get into Canada. CBSA may not let you in if you don’t have travel insurance that you can show covers the cost of giving birth. As well, our government is trying to crack down on the issue of anchor babies the same as the US.
