Hi guys,

Quick question. I entered the US on a K1 May 14th. We got married on May 19th. We are now getting ready to file for AOS. Do I need to file for a I-765 (Application for Employment Authorization) as well, or will I be allowed to work anyway as soon as they approve the petition? And how long can that take? I want to be able to work asap.

Also, do I need to worry about the I-693 or report of medical examination and vaccination record since I had a medical done in Belgium less than two months ago? If I do have to worry about it, what exactly is a civil surgeon? :-p

I realize all this has probably already been answered somewhere on this website, but am a bit on a time constraint as we're only able to access the internet every once in a while, and for limited time slots only. Thanks so much guys, I really appreciate it!

Also, quick extra one, am I allowed to have a drivers license on a K1? I do have a social security number...

AOS can take up to a year to be approved. Once it is approved, yes you can work.

If you want to work before that, fill out I-765. It is free, it will be approved in 3 months and you can work then.

If your vaccinations are complete don't worry about medical. (or read the pinned topic about it outlining the subtleties). A Civil Surgeon is a normal doctor who has done some extra testing/classes to have a special title and responsibility. You can find Civil Surgeons on uscis.gov.

DL- probably not, but check with your state.

You should also file the I-131 too. It is also free when filed with a pending I-485, and you never know if you might need to travel outside the US before your green card is approved. You need the AP to re-enter the US before getting the green card, and you need the EAD to work. They typically issue a combo EAD/AP card now. It can be used in most states to get a drivers license before your permanent residence is approved.
