Hello, my fiance and I have the i 129f approved and its been sent to the consulate in bogota, her interview is june 5th. as far as the i 134 comes i dont make enough money. my co sponsor, files a 1099. he doesnt receive a 1040 or W2. What should I do in this case? Do we both have to file a i 134?

Yes both of you have to do up a 134 form and you both must include the supporting documents for the forms.

You do not receive a 1040. That is the tax form you file with the IRS each year. What does he receive a 1099 for? If it is for self-employment, then he would have filed a 1040 along with some other forms such as a schedule c. He would need his 2012 IRS tax transcript or a complete copy of the return with all forms, schedules and 1099s.

If the 1099 is for some non-taxable income and so he did not file taxes on it, then he should include a statement to explain why he was not required to legally file taxes along with his own I-134. Also, make sure to document very well how much income he makes in order to prove he meets the requirement for his own household size plus the foreign fiance(e). Along with the 1099 that shows the yearly amount from 2012, he may want to include bank statements that show the amount deposited to his account each month to further show proof the non-taxable income.

If he was legally required to file and did not, he needs to file and you might want to go ahead and find someone else to use as your co-sponsor that meets all the requirements.
