hey everyone,

i have few questions...

I am a Petitioner. i have filed i-130 for my husband in Pakistan. we got our approval notice from uscis.

since i dont work and last year i only worked for 1 month. so i dont have any income to sponsor affidavit of support for my husband.
My parents decided to sponsor him. both my mom and dad will sponsor him because they file joint tax return every year.and together they make 80000.

so do i also need to fill I-864.
or only my dad needs to fill I-864? and my mom I-864a.

DAD- Sponsor I-864- primary sponsor
Mom- I-864a - joint sponsor (contract b/w sponsor and household member)

thanxxx

I think you have to be the primary sponsor even if you don't make enough and then the parents are joint sponsors. My situation was similar because I had been in school for the past 3 years so my income was well below the line. I filed the I-864 as the primary sponsor and then my mom was a joint sponsor (filed out a I-864 form) and the NVC accepted that. I am not positive about this though. Hopefully someone else will respond who has more knowledge than I or you can always call the NVC and ask them, that's what I did because I had not discovered VJ yet :(

Best of luck!!! :)

DAD- Sponsor I-864- primary sponsor

Mom- I-864a - joint sponsor (contract b/w sponsor and household member)

Your dad is not the primary sponsor, you are (even if your income does not meet the required threshold). Therefore, you as the primary sponsor must complete an I-864.

Your dad as the joint sponsor will also complete an I-864. If he is combining income with your mom, then your mom would complete an I-864A.
