Hi,

My wife just bought a new Nissan in Canada a few months ago thinking we would be making Canada our long term home. However, we decided that the states would be better. Her car is financed. Will she be able to take it across the border or will she have to sell it before immigrating?

Any advice greatly appreciated.

Take my advice with a grain of salt because I owned and fully paid off my car before crossing the border and didn't finance it, so I'm not sure how that would affect your situation. Hopefully someone else here knows about financed cars.

I am not sure about the Nissan specifics but I am pretty sure you will be fine to take it across the border otherwise. I imported my Toyota to the USA and many others here have also imported their car. On our visa it is duty free if you do it within 1 year I believe. You will need to contact Nissan for a 'letter of compliance' that explains how the car is compliant with US standards (safety and environmental). I'm sure others can give you more specific advice for Nissan, but chances are if it is brand new it shouldn't be an issue. If you are wondering, my car still shows kilometers on the odometer and I was able to import it.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

If your car is fianced in Canada your fiance company must be ok with it. If you read your contract you are probably prohibited from export the car while it is still fianced. If it is fianced through Nissan you may get them to OK it but if through your bank or other place you may have to pay it off first.

This will not be over quickly. You will not enjoy this.

I have to agree with this. When I went to the title agency this weekend to get my Ohio title on my car so that I could plate it there I had to show that the car was fully-owned by me and no leins on it etc. When I imported it at the border I just had to present the paperwork from the manufacturer for compliance but I don't know what else they looked at. My dealership even provided me with a letter as backup to show that there was no lein on it becuase I just finished paying it off a few weeks ago. They did this in case it caused any flags in the system. However, I want to say that I don't know for sure what the border OR the person at the title agency can actually see in their system and I didn't ask.

You should definitely find out from your financing company. I would anticipate that it will likely be a challenge but you may be pleasantly surprised. Please do update us as this is a helpful discussion.

When I moved to the USA 3.5 years ago, Nissan would not let me export my Versa without paying it off first. Unless they have changed their policy this is what you're stuck with. They will not issue a letter of compliance without it being paid off.

Sorry for the bad news :(
