My story in short: I'm originally from Romania but I've been living in Japan for 10 years. I applied for a nonimmigrant visa 3 times and was refused all 3 times. I applied here, in japan. I have two kids from a previous marriage. I married my husband this year, in February.He is an american citizen. I have two kids from a previous marriage. We are now gathering the required documents to file for the immigrant visa.

NOW...I've been reading and reading but I just seem to get more and more confused. What is the difference between a CR visa and a K visa and which one should I pursue?

We read on the USCIS page that while we have the I-130 form pending, I can apply for a K nonimmigrant visa to travel to the US and be with my husband until my case is completed. Is that true???

For that to happen, do I need to also file the I-129F form? If so, when and where do I file it? And who? Is my husband supposed to file it together with the I-130? I know now that my kids will need individual I-130 forms but do they also need individual I-129F forms? They hold japanese passports as well so are able to travel to the US on the VWP

Also, will my previous refusals for a nonimmigrant visa affect the outcome of my petition?

Any advice is highly appreciated! Thank you so much in advance!

The K visa being referred to is the K3. They are essentially obsolete now. They used to be applied for when the CR/IR visas took a long time to process. Now the CR/IR process is about the same length of time as the K-3, so there isn't really any reason to apply for it. It sounds like you are currently pursuing the optimal process, the CR-1.

Follow the step by step guide - forget about the I-129F. Do not file that.

ROC was approved in 3 months and 2 days without interview.
