Hi everyone,

I only happened to come upon this site a few days ago, but it's really packed with information. I'm the beneficiary of an I-130 application that my brother (a USC) filed on my behalf in June 2012. I was wondering if there was any process by which I could provide additional evidence to support my application (without waiting for an RFE). The main reason for this is the proposed comprehensive immigration reform bill which will likely remove siblings as an eligible category. It appears that our best hope is for me to ensure that the petition has been approved prior to the effective date of the Act (even then it's not exactly clear what happens to those of us with recent priority dates). With that in mind, I was wondering if it were possible to submit additional evidence (DNA test, affidavits etc.) just to ensure that we don't lose time through the RFE process.

I called USCIS and it was a bit confusing. I said I was the beneficiary so the CSO immediately clammed up and became evasive in his replies - that's fine, it's his job to only speak to the petitioner. But I explained I only wanted general information that was not specific to any case. So I asked him if there is a mechanism by which my brother could file additional information without waiting for the RFE. He said no. So I said, ok, so just to confirm there is no way to submit additional information while an application is under initial review. And then he said yes there is, and you would just send any pertinent additional information to the service center processing your case (in our case, Vermont). I didn't want to push my luck further by asking him to clarify, probably the easiest course of action is to ask my brother to call instead, which is what I will probably do, but was just wondering if anyone had encountered this issue before?

Please note, I'm not looking for replies that seek to evaluate the completeness of the evidence we had initially submitted - just whether anyone knows whether it is possible to submit additional evidence while an application is under initial review.

Double check what is applicable to your case and ask your brother if he submitted said requirements.

Thanks for the quick reply. My brother is being a bit of a space cadet and can't actually remember what he submitted. I KNOW we did not submit a birth certificate for me (but instead other supporting evidence - what he submitted for me I'm not really sure). Now I was wondering given that an RFE is likely (based on what I have read here about the process), whether there was a way to just submit other conclusive evidence like a DNA test etc.

Some people go ahead and submit additional or lacking documents without waiting for RFE. Include a cover sheet indicating your WAC number, priority date, category, petitioner's full name and date of birth, and beneficiary's full name and date of birth.

I don't think they will accept DNA tests at this stage, because when they demand DNA test between petitioner and beneficiary, it is done only by the embassy's authorized facility. They don't accept results from other 3rd party sources.
