Hi all,

My husband came on a H2b visa from Mexico a few years ago and overstayed. We married and have 2 children. I didn't file for him because of the money and now I can do it. We prepared all the documents for the adjustment of status (I-130, I-485, I-864, G-325, I-765). But we are confused because we dont know if we have to send another form related to his h2b status. I will really appreciate any help.

Moved from work visas to adjustment of status from work visas as the OP is not applying for a work visa to the USA but adjustment of status for someone who entered on a work visa.

Forms are fine, plus the Medical (I-693).

You'll need to send 2 G-325 forms, one for you, one for him.

We have the medical also. What is stopping us for filing the application is that we dont know if we have to treat it as if he were in a b1-b2 status. Do we have to send also a waiver because he stayed after his h2b visa expired?

As long as you are US citizen - no. You are good to go as you are right now. Send it out and you will be fine.
