What situation is "this situation"? Are you saying you've seen people be successful adjusting status with a NO AOS notation by CBP in the passport? I get that they don't have the final word on this but that notation DOES change the risk level. We don't yet know whether there was any such notation.

I have.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

I have.

Then, by all means, please elaborate.

Please be specific. It will help to avoid pronouns like "this". Unless you can be specific, I would advise the reader to ignore your posts. On the other hand, if what you say is true, I would be very interested in learning more. It will take more than a few scattered cryptic comments though. Can you do that?

It seems pretty simple but let is try again.

1. The use of a no AOS annotation seems very rare.

2. There have been cases on VJ where it has been used but the people concerned have still adjusted. Indian Parents who entered from Cnada comes to mind.

3. It appears that such annotations have no real effect.

4. I have yet to come across a case where this annotation has caused a problem.

5. The OP does not have one so all moot anyway.

6. If I had this annotation and wanted to adjust I would certainly double check it. I would not assume it is an automatic block on adjusting.

While that may be the best you can or will do, it is still pretty cryptic. A couple comments. It would be far more valuable to cite more than one successful case and have it be a spouse rather than parents, then be. I expect you won't see many failed cases with the NO AOS notation because there won't be many attempted cases either.

How would you "double check"? You see, it sounded like you were advising them to simply go ahead, not "check". Just what kind of "checking" did you have in mind? Do you understand now why I referred to your comments as "cryptic"?

If you have a less than straight forward case always a good idea to seek a consultation with a competent Immigration Lawyer.

The site has a search function.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”
