Second Marriage

Good Evening,

Hi! I was married to a Colombian National and I did all of the paperwork through CIS (legacy INS). We were married for 6 years until we got divorced (infidelity on her part). I have been divorced now for 3 years and I have been going out with another foreign national. My question is that if we ever decide to get married, will CIS/INS revoke me because I sponsored my ex- spouse into the United States.

They may take a closer look at your case since you sponsored one alien, divorced, and are now sponsoring another. Provided you can prove a good faith marriage though you should not have an issue.

We're in the same situation, both been married before and it's the second time my husband files for a spouse (first time was many years ago). It shouldn't be a problem as long as you declare it on the I-130 (you will need date, place and outcome of your first filing). Also, be sure to provide lots of evidence of your relationship, don't just send in the minimum. Save your photos, plane tickets, emails etc to prove you have a genuine relationship over however many months/years.

Is you ex-spouse still in the USA? Is she a citizen or is she still an LPR? If she is still an LPR and in the USA you must count her on the Affidavit of Support.

I agree with the other posters at making sure you prove this marriage is bona fide and genuine with as much evidence as possible.
