Hi Good people of VJ,

I have hopefully a simply question.

I landed to this great country in November 2011, didn't start working until May 2012, and I have some questions in doing my federal (and state) tax return.

I'm stuck on the question whether I was a non-immigrant for any part of 2012.

I landed here on a K-1 VISA in November 2011.

I got married in January 2012.

I filed for and received my green-card in September of 2012.

My question is, for tax purposes, was I a non-immigrant for the entirety of 2012 (maybe I still am??), part of it, or was I classed as an immigrant from when I landed here.

I know that the K-1 is a non-immigrant visa, but I have no idea if I should tick that box on my tax return.. HELP!!!

I am filing jointly, my question was more did I become an immigrant once I got my green card, or when I landed in the US, as I got my green card (from K-1 visa) in September of 2012.
