Hello VJ family! Maybe someone can help me out. I have filed my petition for my Fiance March 6, 2013 and I am still on the initial review. I don't really know when exactly we will get approved but my Fiance is taking his RN exam in July and I am afraid that if the petition gets approved before he takes the exam he might not be able to take it in July.To those who have already been approved and have their visa what is the expiration of the visa? Not sure if I did the right thing of filing the petition...should I have waited until he takes the exam?

Your visa won't be approved by July unless your case was expedited for some reason.

Just like everyone is saying, most likely not to be approved by July, my NOA2 came in the 7th month. However, if you are lucky enough tobe approved by or before July, then your visa will be valid for 6 months from the date of issue.

Thank you all :) I filed the petition since I know that it take about 5-7months to get approved and he probably wont get here until late Dec of this year or maybe early next year but after what someone told me that I did the wrong thing about filing it now because it doesnt take that long for a petition to get approved he might not be able to take his nursing exam...so I got kind of worried. Makes me a little relieved to know that he can still take his nursing exam in July :)

You did the right thing. Your petition could easily take seven months or more to be approved, followed by another month or two before your fiancé has his interview. Then, once his visa is approved, he still has six months (from the date of his medical at St. Lukes) to enter the U.S.

Even if your petition were approved much sooner, you would still have no problem because the petition is valid for four months and the U.S. Embassy Manila will extend the validity of your petition for up to one year if you request it.

To sum it up, here's how long you and your fiancé potentially could stretch out the process:

> 7 months -- approximate time for USCIS petition approval.

> 12 months -- maximum petition validity including Embassy extensions.

> 6 months -- validity of his visa from the date of his medical (he'll probably complete his medical a week or two before his interview).

> 25 months -- total. That should give your fiancé plenty of time to pass the NLE, even if he has to take it a few times!!! :whistle:

I doubt it will be approved by July. VSC processing time is 5 months so you have nothing to worry. Good luck! :)

I agree but even if they are lucky enough to be approved they would still need to do the medical and interview and those could be stalled long enough for them to take care of what they need to do
