Nope. He needs to be fully divorced. you have to provide copies of his divorce paperwork in your evidence.

In submitting your petition, you both have to be able to prove you are willing and ABLE to marry. If his divorce isn't complete prior to submission then he isn't Able to mary you. We had to wait on the same thing for my divorce. It is all a waiting game. Patience is all I can say.

My fiancé's divorce is not yet final, can we go ahead and file a request for K1 and wait for both?

How long before the divorce is final?

You can still get all the paperwork ready for application and put together the evidence of your relationship. Remember you need to send a copy of the divorce certificate before you send the application off.

Be sure also to check if the State where your fiance will divorce (and marry you) has not a "waiting period" after his divorce to remarry. Some states have a 30 days waiting period where you can't marry after a divorce. If you send your I-129F during that time, you may be denied.

A couple on VJ sent their I-129F during that waiting period, they waited a long long time, until they got a denial because of it.

You both need to be FREE to marry at the time your send the petition.

K-1 Visa Timeline AOS Timeline

- Aug 31st, 2011 - Mailed I-129F package - May 29th, 2012 - Mailed AOS/EAD/AP package

- Apr 13th, 2012 - Visa received - Aug 24th, 2012 - Green Card received

ROC Timeline

- May 19th, 2014 - Mailed ROC package to CSC

- Aug 8th, 2014 - Green Card received

N-400 Timeline

- Dec 29th, 2021 - Filed online. Got notice that biometrics will be reused.

- Now waiting...

Meaning copies of the certified divorce decree must be filed along with the 129f petition.
