I am currently a student, but because my taxable income is below the 125% poverty line threshold, my parents have agreed to be joint sponsers for my wife. My question is, do I give form I-864 to my father, mother, or both? Both of them work, and both of them earn over the 125% threshold, but they filed their taxes jointly. Can I state on my I-864 that my father is the only joint sponsor for my wife, then have him fill out I-864 and have my mom fill out I-864A (as a spouse of the joint sponsor) and just include their latest joint tax return? Thanks so much in advance!

You I-864.

One parent: I-864

Other parent: I-864A

Read the instructions on the supporting documentation. One tax return is not enough.

Thanks for the reply. I'm not sure I understand "One tax return is not enough." For both my dads I-864 and my moms I-864A, are you saying that I need multiple years of tax returns? In the instructions it says just to include the last tax return. Since they are married and filing jointly, can't they just give me their latest tax return? Or should I just include two copies of their joint tax returns? I would also submit my latest tax return with my I-864. Thanks again.

No. Harpa was saying just the joint return was not all the documentation you need. Your parents also need to provide letters from their employers and most recent pay stub(s) to prove their current income. They also need proof of being a USC or LPR.

Nope, that is not what I am saying. Read the instructions again, and the I-864 checklist on uscis.gov.

Thanks for both of your replies. I am familiar now with the instructions on what my parents should submit; most recent tax-return, W-2, letter from employer, and copy of US passport. My question now is this: can I just list my dad as a sponsor if he alone makes more than the 125% poverty line despite him filing joint tax returns with my mom? Then only my dad and I would fill out I-864, and I wouldn't have to have my mom fill out I-864A. Thanks again!

Yes. He lists his individual income and makes sure to supply his W-2 so his separate individual income is proven since he will use a joint transcript. The employment letter and pay stub with YTD income also proves he earns enough on his own.
