my fiance (a US citizen) and i are planning to apply for the K-1 visa in April, we met a couple of years ago while i was in the US.

At the time I was married and in the US as a permenant resident, after the marriage broke down and we got divorced, i moved back to the UK.

so my question is, will the fact i was over there already via marriage effect our case to the point of refusal??

I don't see why it would. As long as you were in the US legally and have not overstayed and you are now free to marry again then why would there be a problem?

I don't see why it would. As long as you were in the US legally and have not overstayed and you are now free to marry again then why would there be a problem?

I've spoken with uscis and my previous case was closed with no problems, i didn't over stay or anything like that. I did speak with an immigration lawyer in London and he said we may have problems as I've already been over on a marriage visa and now im looking to return??

It is suspicious, but you were a LPR and did return to the UK after your marriage ended even though you didn't have to. I think that speaks volumes in and of itself. Had you wanted to stay in America, you could have and chose not to. If I was a CO, I'd probably think you weren't trying to get to America, but probably had a bit of a soft spot for Americans. :lol:

It is suspicious, but you were a LPR and did return to the UK after your marriage ended even though you didn't have to. I think that speaks volumes in and of itself. Had you wanted to stay in America, you could have and chose not to. If I was a CO, I'd probably think you weren't trying to get to America, but probably had a bit of a soft spot for Americans. :lol:

I hope uscis see it like you nola..lol

If the UK hadn't made it so expensive my fiance would be moving here but the changes they have made have made it impossible financial for us :(

I think that when you apply, you are just as honest as can be in regards to your previous stay in the US. Yes they will look into it, that's what they are meant to do but if you did everything right last time then I am sure it will be ok this time too. All I would say is make sure you have ample evidence of the relationship.

I have the exact same situation and I am NOT worried. Did you sign I 407 form upon returning to the UK? Unless you overstayed any visas you shouldn't be worried. When did you divorce?

I 407?? my divorce was finalized in July of last year, not long after i moved back to UK

the evidence thing bothers me a lil, there was nothing between us while i was over there obviously as i was married, i think we've talked everyday since i got back but mainly on free messaging and call apps, none of which we can export and print the conversations on :(

jess will be over in early April for a visit so we will have pics and things from then but other than that??

the requirements are: free to marry and meet in person over the last two years. If you meet in April than you meet both requirements. Keep all the boarding passes fro the April trip, book a hotel room maybe and make sure both of your names are on the hotel receipt, take pictures with the family members.

If your previous immigration case is closed properly than I don't see how you could encounter any problems this time.

Start using a means of communication that you can print from. I mainly use Skype video but we have emails, Skype chat, letters, cards, photo's, facebook comments and probably more. I pay a subscription to Skype so I can call his cell and home phones. It logs that I made the calls. Every little bit helps.

PURPOSEFULLY generate different kinds of evidences.....because you will have to convince a total stranger, the Embassy CO, that you have a legitimate relationship.
