We got the NOA1 on January 28th and finally yesterday (March 13th) our case was forwarded to a field office. The bad news is that the military expedite got denied because there are no medical reasons why I should be in the States earlier?!?! I don´t get it. I never heard that you need medical reasons. My husband talked with the head of the department and he said that we don´t have to ask for another expedite again because it will get denied as well. Has anybody ever dealt with that? Our expedite was handeled as OTHER not as military for some reason.

We received an email saying that we should get a notice within 90 days. What does that mean? Is that the NOA2? Are 90 days a realistic time? We were also told that it would take 5 days to decide, if we get the expedite and it took over a months.

Our 420$ check still did not get cashed. Did they simply forget to do that?

I´m confused how far in the process are we?

We did not get the NOA1 by mail, only email. Is that a problem?

from the field office we got the following info:

Due to high volume of expedite requests for this case type, we are strictly enforcing the criteria that has been set for these expedite requests. You have not provided ecidence of an extreme emergent situation. your case is currently under review. you should receive a decision or notice of other action within 90days of the date of this letter.

One thing here, I am assuming you are living in Germany while your husband is in the US? I say this because typically couples who are living and filing abroad get processed much faster. Now as to your military expedite, these are typically granted when the spouse in the military is about to be deployed. Is this the case for you? If it is, then you should file an expedite request again with a copy of your husbands deployment orders.

thank you for your fast answers :)

yes I live in Germany and my husband normally in the States. He already is deployed to a combat zone and we wanted to speed up the process that I can fly there and stay legally as soon as he gets back and that my child can start school there instead of starting here and then move after a month or two.

We did send my husbands orders in our petition.
