I received NOA1 on August 22nd through csc. Now, I had no problem waiting although it is extremely annoying seeing vsv flying through noa2 and csc being stuck on July 18th. It is getting really hard for me though, not because I am separated from my other half ( we have been in a long distance for years) but because my 7 yo son has had recently the worst asthma attacks I have seen in his life in the climate and place we live in right now. Now, my son is a US citizen living with me in Poland and we don't have a health insurance. Moving to California would improve his health tremendously as it was proved in the past. His dad is also a usc living in California with shared custody but unable to take care of our son by himself until I receive K1.

Do you think I should give it a shot and ask for expedite? I know I am alomst there, but it could be months as well before we fly over there.

I doubt it is strong enough, as they will argue the father needs to make better childcare arrangements so he can look after his son until you can join. Then again if you have good doctors letters it's worth a try. Most of the time, a denied expedite has no adverse effect and even if it does, it would only delay your case a couple of weeks so worth a gamble, especially as your case has been processing a while.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Then again if you have good doctors letters it's worth a try. Most of the time, a denied expedite has no adverse effect and even if it does, it would only delay your case a couple of weeks so worth a gamble, especially as your case has been processing a while.

If his father is a US Citizen, then the child born of him do not need to wait for a visa.....they are immediately eligible for CRBA at the Embassy and receive his US Passport. Do this if it applies and send him to CA now.

She probably doesn't want to leave her son behind, neither would I. I say try it. They approved our request to expedite and we had much less pressing reasons (just financial ones). You don't have anything to lose and you won't know unless you try.
