I need some assistance & appreciate the input from anyone who reads this.

I’m a US Citizen currently living in Mexico with my Mexican wife.

The 1st week in January I paid a respectable immigration lawyer to file an I-130 petition on my behalf. As of today, roughly 45 days later we haven’t received the initial reply with the received receipt / case number from USCIS and when I call them they tell me I am not yet in the system, indicated they have not received any petition from my lawyer.

The lawyer who processed our I-130 told me that there’s currently a known backlog in the initial processing, and it may be a week or two longer before we receive any reply from USCIS confirming receipt of my petition.

Is there a known backlog or delay in the initial processing of I-130’s from Mexico?

It has been 45+ days and we have not received any communication from USCIS.

Should we be calm or concerned?

Usually doesn't take that long to receive a response from immigration, it takes up to 45 days to check status of the application once you received the receipt.. They usually send out the receipt whitin two weeks of the received application and the process to get it approved is what takes longer to find out the status..

Thank you for the reply.

I gave him cash for both his services and for the fees, I know that sounds foolish, but I have utilized this lawyer before and he has always demonstrated complete professionalism, therefore I didn’t give it a 2nd thought. I am guessing his check has not been cashed though.

your check should have been cashed. check your bank statements,did you file G-1145 to notify you of received your file.or e, mail .or tex message,or call the 1-800 number customer service number an ask if it was received,ask your lawyer if he sent the package with delivery confirmation, to track it,
