My Wife and I filed to remove her conditional Green card and get a permanent G Card last March (12-March-2012) we have received a latter indicating a year extension and she went for Bio Metric but since then I haven't heard from them, its been almost a year since I filed and on the website still is showing "Initial Review" I have started worring about this as its been almost a year, what should I do?

First thing first, make an InfoPass appointment to your closest service center, ask for an I-551 stamp to be stamped on your passport. That way you'll get another year extension on your current status.

Next, get hold of your local congressman and seek help.

This step is optional, if your ultimate goal is to become an US citizen AND you are still married, has reached (which I am sure you have) 3-years GC since date minus 90, then file for N-400 (Citizenship). That way it'll force USCIS to make a decision on your condition removal.

Can they ever reject the application, we are still married. they only thing is once I got arrested but the case got dismissed on the first day.

They have to send you in writing about the INTENT TO REJECT. However that doesn't happen very often, if not rare.

Just do what I suggested and keep yourself in-status while push them to finish your case.

did you get arrested before or after filing? If before, hope you filed the court certified disposition as stated in the form instructions.

if after filing, then it might be causing the delay. perhaps you can send it in now along with a brief cover letter.

Also call them, it takes time and patience but you finally do get to speak to a rep on the phone. they're open till 8pm eastern. Ask if any RFE was ever sent but perhaps misplaced in the mail, etc.

What was the arrest for, but I dont think the arrest has anything to do, right now the ROC is taking far longer than normal.

Calif center was taking anywhere to 6 months to process the application while the Vermont was taking 9 months.

Your case might just have been misplaced or something, as recommended make an info pass appointment, extend it for another year and seek your congressmans help and at same time if interested your spouse would be eligible to apply for USC which can be done as well.

Don't worry, as long as you send in the paper regarding a dropped charge then you should be fine.

ROC has been back logged for a while now, just remember as long as you keep yourself in-status with an I-551 stamp on the passport, and file for N-400 or get hold of your congressman, either way will push them to make a decision.

Isn't this the ROC for your wife's GC? Why you being arrested affect her ROC? Just wondering.

You can call the USCIS and ask them to put a service request in to find out why you haven't heard anything. It may be quicker than making an infopass to get the stamp. We actually had an interview for my husband's ROC that we sent in a year ago. We couldn't get the stamp to extend his extension letter because the officer we talked to said that the letter is good until a year of the date stamped for his arrival to the US. We were told to come back in the beginning of April if he hasn't gotten any reply about the interview.

this may be a long shot, but perhaps as a last resort, you can call up the court and ask the court secretary to check their internal records & NCIC to ensure if they correctly updated their records to show all charges were dropped.

there's a (very slim) chance that even though they issued you dismissal docs, they might not have completely updated their internal database.

something pretty similar had happened to my landlord's husband, that's why I thought of it.
