hello,

the petition was recieved at the end of august ( vermont),we keep checking online and its still on the FBI checks part,and its now early february,my house is up for sale and no offers as yet only lookers ! so im now panicking and thinking of letting it,i have a work van ( im self employed) and a car i need to sell but havent done that yet till i get to the interview stage,ive sold or given away some of my furniture,but the house is the main worry and dont know what to do ? im confused about the visa for when i get it ( hopefully),the question i need advice on is do i need to immediately book a flight and go, or can i delay going for a month or so if there is an offer on my house if i reduce it for a quick sale ? or till i get a rent on it ? i need to get it sold or rented but i dont want to be homeless and out of work till i have the visa ! anyone else had the same problem as me ? i would love to listen to advice from experience ! i feel its like playing one of those kids games with little ball bearings and they all have to go into little holes but its hard to get all of them into the holes at the same time ,one goes in and another rolls out and there's a time limit to add to the pressure ! you know what i mean ? it would be more sensible to rent as ive paid off most of the house but then again im not keen on being 3000 miles away and an agent dealing with problems and problems with the IRS with a foreign income and property,the equity would be useful too but i dont want to give it away either ? :wacko:

Your post is very difficult to read due to the lack of capitalisation and punctuation.

If I understand correctly, you are worried about getting the visa too quick, before your house is sold. You have two options:

1. Delay the whole process by taking your time sending back the next set of documents

2. Usually, a issued visa is valid for 6 months (unless the medical was done way ahead of interview)- use that time.

You can indeed rent your home out- that is what we did with our flat in Dublin, it was nice to have that extra income while we got settled in the USA and looked for jobs here. But yes, make sure you either get a good letting agent (they wil take a hefty %= up to 14% in Dublin anyways), or get a very trustworthy friend to do it.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

It would be nice if someone agreed to purchase your home but delayed moving in until you are approved. Chances are, that is not going to happen. You post sounds like you have one foot in UK and one foot in America, this is not a good situation. You need to look for options, a place to live. Then get serious about selling or renting the house. Trying to balance the house, place to live, selling, etc will drive you nuts. I would make a decision to get ready for moving, find a temp. place to live if the house sells, put real effort into selling house and getting your affairs in order and ready to leave.

Nevertheless, once the visa is issued, you have 6 months before you must immigrate. After 6 months, the visa is cancelled and you must start over again.

So you are maybe a month away from petition approval. Then add on 3 months to get your visa in London if you push it. You can drag that out a bit by not rushing to submit the three things required before London will assign an interview--

  1. Visa application forms
  2. Medical results
  3. DS-2001 readiness for Intervew form.

Here's what London says about the validity period for the visa and the option of extending it.

Validity Period of the Visa 

The validity period of an immigrant and fiance(e) visa is based on the  validity period of the medical examination, the maximum validity of which, is six months.  You will be advised further at the interview. The K-3 and K-4 visas are usually valid for two years and will allow the holder to travel in and out of the United States. Children will be issued visas valid for two years or until the day before their twenty-first birthday, which ever is shorter.

If, for any reason, you are unable to use the visa, it should be returned to the Embassy with a covering letter indicating whether or not you wish to immigrate to the United States. Consideration of the issuance of a new visa will only be given if the individual is able to establish that the reason for not traveling to the U.S. during the validity period of the visa was due to circumstances beyond his/her control.

You might ask at the interview what they would consider as a valid reason for an extension. It would require a new medical exam, I would think if six months had passed since the first one.
