thank you for your reply. do you think that as long as i have year 2011 tax transcript and not the year 2012 transcript that it will be ok. reason that i ask is becaused i am in the 90 day window for my wife and i would like to send out the 1-751 package right away. i am picking up my tax return on friday from my accountant and then i am going to the post office to send out my income tax return. i guessed that i won't be able to order the tax transcript for year 2012 becaused our tax return won't be in the irs system. any more replys will help. thank you again.

For 2012 returns it's early enough in the year that USCIS probably wouldn't expect everyone to have got their returns ready yet and so probably won't be looking for it in your packet. However, since you have it done, go ahead and take a copy of then entire return, including all W2s and send it in with your packet.

Good idea - specially since the application will reviewed much later and we don't know which dumb guys our case for review - at least the 2012 tax return copy helps. It is good to mention the same in the cover letter.

Can I know why I need to send in W2s? Thanks.

If you send transcripts, you do not. If you don't, you do. The transcript already contains that information as reported to the IRS. If you send a return, they have to take your word that is what you sent the IRS. The w-2's are also reported separately to the IRS and are filled out by your employer, so they are just another piece of evidence supporting what is on the return you filled out and you said you sent to the IRS.
