Does it matter if my husband has not had his job for long?? I mean my lawyer got an RFE for affidavit of support and he has only been @ his current job since Aug. He is making enough way above the poverty gudelines. We r going to send a letter with all that info Im just wondering if I will still have problems !!!!!!!!!!!

Proof of income can be a letter from his employer on company letterhead stating that he is in a permanent full time job and copies of all recent pay stubs, in your case all pay stubs from the new employer.

Shoe, since you are continually getting RFEs and seem to be a little confused about the requirements for this process, perhaps it would be helpful if you ask your lawyer to explain each step to you, including the necessary documentation. If the lawyer tells you what is necessary and actually checks the forms and evidence before it is sent, you can avoid getting future RFEs.

We do have check stubs but the employer will not commit to saying the job is permanent.!!! But its all good GOD for us all. Im trying to keep the faith.

He should be able to get employer's letter. They don't need to mention it's a permanent position. Basic elements of the letter should be: average hours per week, wages paid, title and duties performed if I recall correctly. It has to be on a company letterhead and signed.

What immigration cares the most is the CURRENT salary. Your husband qualifies to be your sponsor since he is currently employed and makes more than required by law. You can also include your income when you get your work permit. And also, please do send pay stubs and bank statements for your shared account showing monthy deposits. I think that is very important factor.

In the end, it all depends on adjudicating officer. Just do what you can and hope for the best.

I have read enough to understand that if he gets the response from an employer as an employee in good standing, things should be fine.

You should be able to sort this out amongst you. If anything is left to question, is a co-sponsor a viable option?
