Good afternoon from Minsk,

This question came up in another thread (http://www.visajourney.com/forums/topic/412203-i-134-supporting-documentation/page__p__5952028__fromsearch__1#entry5952028), but it was a follow-up to my original question and got buried in the mix so I will ask again here:

Like many of you, we spent countless hours trying to submit an absolutely flawless, inscrutable petition... but we still made a mistake. My fiancée has gone to the U.S. embassy in Moscow 3 times for her C1/D visas, which she needed for her job on a cruise ship (where we first met). Because of this, we incorrectly assumed that she would apply to the Moscow embassy for her K1 as well. VJ member vbtwo astutely pointed out that Belarusian citizens apply at the embassy in Warsaw, not in Moscow. Our petition has been at the CSC since August 3, 2012, with "Moscow, Russia" written prominently under item number 20, "Your fiancé(e) will apply for a visa abroad at the American embassy or consulate at: ______."

I called USCIS and was told to send a letter to CSC asking to correct the mistake and forward her (hopefully) approved petition to the proper embassy. That letter went out immediately, but I am very worried.

What happens if the petition is approved before they receive the letter?

Or if the letter never makes its way to our file?

How can I confirm that her case will go to Warsaw and not to Moscow?

What will we have to do if her case does, in fact, end up in Moscow?

Please share any and all ideas/suggestions/etc. I am kicking myself for making such a mistake, but I want to be sure that I do everything possible to rectify the problem quickly and effectively.

I called USCIS and was told to send a letter to CSC asking to correct the mistake and forward her (hopefully) approved petition to the proper embassy. That letter went out immediately, but I am very worried.

Firstly, no file is ever sent directly from USCIS to an Embassy or Consulate, it goes to the NVC first.

Secondly, this is a non-issue. Even if the approval notice you receive from USCIS lists the location you put on the form. The file goes to the NVC and the NVC will route the file to the proper location based on the address of the beneficiary. So for your case, if Warsaw is the proper location, then that is where the NVC will send the file.

July 23, 2025:  Filed N-400 online

Yes, I know the case goes first to the NVC. I wonder why they would ask on the I-129F which embassy/consulate she will apply at if they automatically forward it to the default embassy anyway.

I had a similar question.. I had put Yekaterinburg consulate as the designated location since that is where my fiancée got her J-1 visa last time. And that was how we met. However, Yekaterinburg doesn't process K-1s. Only Moscow does for Russian citizens. Well after I129F was approved, NVC sent petition straight to Moscow.

I would assume they would send your petition to the proper location irrespective of what you wrote.
